A Florida couple wanted a night of drinking. Determined not to let the presence of their 3-month-old son deter them, their actions left them with a morning after full of headaches and legal complications beyond their wildest nightmares.
Antonio Nieves, 28, and Amy Scahfer, 27, were charged Tuesday with child neglect without great bodily harm for placing their son in a child carrier on the sidewalk outside a bar while they were drinking inside. Nieves also faces a domestic battery count for allegedly punching Schafer in the face.
The saga began around 1:30 a.m. on Tuesday when the couple went to a bar in Margate, Fla., with their baby. Nieves allegedly put the baby on a bar stool, but the bar’s manager told them that was not allowed and said the infant could not stay inside.

“So she left her child, her baby, outside the front door in a car carrier while she went inside to consume alcohol,” Broward County Judge John Hurley said at a hearing for Nieves and Schafer. “She would go outside every five minutes to check on her baby and go back inside and continue taking shots.”
The night of drinking did not go as planned. The couple bickered a while and left, court documents quote the bar manager as saying. Then things got even worse.
Police responded to a call about an intruder trying to enter a private residence. Nieves was found at the scene with the baby. A police report says he had bloodshot eyes and smelled of alcohol. Schafer was waiting in the car. She had some facial injuries and smelled strongly of alcohol. Schafer told police Nieves, whom she referred to as her fiancé, had punched her at least three times for hurling an insult at him.

In addition to the criminal charges filed against Nieves, the couple has, for now, lost custody of their child. Child Protective Services will keep the child for up to six months as the government evaluates where he should live.
