As the bombshell news came out about New York Assembly Speaker Sheldon Silver’s arrest for five federal counts of corruption, the New York Assembly Democrats have chosen to stand with him through the case. Although he cannot be removed from his post as the most powerful Assembly Speaker in New York’s history until he has been convicted, it is feared by some that his power has been diminished greatly.
In an attempt to maintain the power he has in the midst of his scandal, Silver is planning on appointing the Assembly Majority leader and four down-state New York City Democrats into a power sharing structure that is not prescribed anywhere in the New York State Constitution. This scenario kind of reminds me of a Mafia Don sitting in his ivory tower, giving directions to his lieutenants to carry out his will. Although many in the Assembly chamber are calling for Silver’s immediate resignation, he does not plan on going anywhere.
The only recourse I have been able to find through my research of the New York State Constitution is found toward the end of Article Three which reads, “An apportionment by the legislature, or other body, shall be subject to review by the supreme court, at the suit of any citizen, under such reasonable regulations as the legislature may prescribe; and any court before which a cause may be pending involving an apportionment, shall give precedence thereto over all other causes and proceedings, and if said court be not in session it shall convene promptly for the disposition of the same. (Amended by vote of the people November 6, 1945.)”

So, as usual, it is up to WE THE PEOPLE to file suit with the state Supreme Court in order to see that Justice and TRANSPARENCY prevail. We can no longer stand idly by and watch the power players in New York go from three men in a room to eight!!!
