Secretary of State Hillary Clinton’s expected signing of the United Nations’ Arms Trade Treaty has once again raised the question of whether the terms of a treaty can take precedence over—even nullify—the rights acknowledged and secured by the Constitution of the United States.
For decades, apostles of one-world government have endeavored to convince the American people that treaties, rather than the Constitution, embody the supreme law of the land. In 1952, Secretary of State and Council on Foreign Relations member John Foster Dulles told the American Bar Association that “Treaty law can override the Constitution.” “Treaties for example…can cut across the rights given the people by their constitutional Bill of Rights.”
But the Supreme Court has more than once decided against the propaganda of the new world order crowd. In the landmark case Reid v Covert, the Court ruled”…no agreement with a foreign nation can confer power on the Congress, or on any other branch of Government, which is free from the restraints of the Constitution.” In short, as “[the Supreme] Court has regularly and uniformly recognized the supremacy of the Constitution over a treaty,” the Constitution remains the supreme law of the land, and treaties may neither supplant nor amend it.
However, treaty articles have been willfully applied in the U.S. regardless of constitutional requirements or Supreme Court decisions. A century ago, Theodore Roosevelt signed and implemented the terms of a treaty “..for two years before the Senate acted.” He later stated that he “…would have continued it until the end of [his] term, if necessary, without any action by Congress.” Roosevelt claimed, “the Constitution did not explicitly give me power to bring about the necessary agreement with Santo Domingo. But the Constitution did not forbid my doing what I did.” (3)
Would a re-elected Obama follow Roosevelt’s example by pressing the Arms Trade Treaty on the American public? Certainly, the Eric Holder Department of Justice would have no compunction about enforcing this latest of Obama’s unconstitutional schemes to undermine the 2nd Amendment. And how could the combined might and authority of the executive branch be prevented from exploiting the terms of this document in a federal assault on the right to keep and bear arms?
The Reid Court wrote that “…an international accord that is inconsistent with the U.S. Constitution is void under domestic U.S. law, the same as any other federal law in conflict with the Constitution.” But if Barack Obama was willing to inflict the unconstitutional terms of a treaty on the American people, he would certainly be willing to ignore any Court ruling that sought to prevent it.
Though Congress has the authority to nullify a treaty legislatively and federal courts have the power to overturn any unconstitutional terms, the American public has learned that neither of these institutions can be trusted with the defense of the Constitution or the rights it secures. Should Barack Obama win re-election, it will be up to the people to defend their 2nd Amendment rights. And that could make for a very messy affair.

He that says the greatest army no longer exsists forgets we vets are old but were still here. Soon we will get reinforcements when they end the conflicts in Iraq and Afghanistan. Less than 35 percent of the folks during the revolutionary war actually participated in the war in any way. While over 30 percent did not even support it. Consequently, I suspect your analogy is incorrect. I am personally a veteran and I will, if necessary, fight for what I believe in (even at my age of 73) and I suspect I am only one of possibility millions of veterans who will support the freedoms we have become accustomed to even though we have been losing those freedoms under the last two, maybe three, presidents. However, under GW I suspect it was because of 9-11. Whereas under obama his goal is to, as he promised, fundamentally transform America. I suspect that transformation will begin in earnest if he is able to confiscate the guns. Therefore, it seems to me we have no choice but to fight. One hundred seventy million people were murdered by their government(s) during the 20th century. If obama has his way the 21st could be even worse. One final thought for you. If you or anyone else thinks that could not happen here they are sadly mistaken and if I’m right it will be to late to matter! That’s how important the November election really is!

You are 100% right! I am almost 63, not in great health, but still as stubborn & ornery as I ever was, & I’m not about to just lay down & let them walk over me. They’ll have to kill me to do that. And, what they fail to realize is, that, when they take my life, they are actually doing me a favor, ’cause as soon as I take that last breath, I’ll be in the arms of Jesus, & then when the Great Tribulation is over, come back with Him, to help rule the earth. So, I’m not afraid. And, I know that the majority of our vets aren’t either, plus a lot of the active forces aren’t either. But, that is also why there are already Russian troops secreted on our soil, & have been for a while now. Plus, you know that Russia, or Iran, or even North Korea would be more than happy to send more troops in! But, they fail to realize what they are going to encounter. That same rebel spirit that was alive during the first revolution, is still alive & well these days. A lot of the younger people may not have that spirit, yet, but wait until the government starts trying to MAKE them do things. It will awaken a sleeping giant, & one that Obama & his people have never dealt with before!

I am a Vietnam Vet and I assure you that there are many more like me that would not hesitate should necessity dictate, to take up arms in defense of my country and the Constitution.
If you ask, in private, a Vet what their opinion on this subject is it will almost always be the same as mine – Hope it never happens and be prepared if it does.

Many of our arms and gun parts come from other countries. In so as much as other countries sign and abide by the treaty it will affect US gun owners. These guns and parts i n he treaty are required to be registered and followed to their destination. Thus regiatration, thus followed by confisgation.
That could be a good thing for us, these manufacturers may bring their business’s here to manufacture their product within our borders to get around the international registry, thus bringing more jobs to this Country.

Other Countries can easily be controlled with this UN arms treaty because most other Countries constitutions or laws of the land lack their basis right to bear arms and so on as our Constitution guarantees us along with the right to overthrow the government. Therefore, in order for these foreign owned manufacturers to remain in business, it would likely be in their best interest to move to possibly the last and only Country that maintains the right for citizens to own their own guns.

Throughout the years, History has proven that everything runs in cycles. financial cycles, weather cycles / patterns, planetary cycles, tyrannical leaders and dictators and so on and so forth, what ever it is it all comes and goes. History has also proven that sooner or later all people regardless of cultural beliefs or race when pushed to far and enslaved to much will rise up and fight for the same cause every time. FREEDOM and LIBERTY being that cause. However, it will have to get much worse here in America before it gets better. How would you like to have to litigate every one of these issue all the way up to the SCOTUS, which may or may not hear a case, and even if they did it could take 50 years to get there, and even if they did they might not rule in favor of liberty. Can’t happen?

I exist in New Jersey, next to California one of the nearest to police states in USA. I had to get written approval from the NJ Government to buy a gun. If I want to buy another handgun,
although I have a license, I have to apply again. Each handgun needs a special license.
I can buy from anywhere in the USA, but the gun has to be collected from a licensed FFL dealer.
So they know where to watch and who they have to put the screws on.

Mr. Obama is not the president. He has never been the president. He is a criminal illegally occupying the White House.
The illegal election of the ‘Manchurian’ Muslim from Mombasa must be retro-actively abrogated. Everything his illegitimate administration has accomplished complicit in the crime of many centuries – the inconcievable crime of usurping the presidency of the United States of America – must as well be retro-actively abrogated for it was all accomplished in the commission of crimes against ‘We the People’ and our Constitution.
To permit Mr. Obama’s accomplice, Joe Biden, to succeed him in the perpetuation of the crime is ludicris. Mr. Biden would then be put in a position where he could issue an Executive Order pardoning Mr. Obama for the most horrendous crimes committed against the American People in our country’s history.
Government officials in Hawaii, administrators at Occidental College, Columbia University and Harvard Law School, Republican and Democrat party officials, and many others complicit in the crimes of Mr. Obama must be brought to justice along with the agent of Islam, Mr. Obama, one way or another.
Changing the metaphor of our ship of state to one employing an air-ship, or an airplane as it were, we would do well to embrace the words of the heroes aboard Flight 93 who rushed the cockpit in an unsuccessful attempt to save all those aboard the doomed plane as we consider the steps to take in removing the criminal usurper from the White House and let our battle cry be, “Let’s Roll.”
