A Marine who was fatally shot in his Arizona home earlier this month reportedly never fired upon the SWAT team that fired at him 70 times. Pima County Clarence Dupnik, who blasted Rush Limbaugh for the shooting of Rep. Gabrielle Giffords team was responsible. The so-called drug raid, turned up no drugs.

A drug bust that turned up no drugs, the victim did not fire one shot, and the video shows the firing started within seconds. Something fishy going on. I can understand the adrenaline rush going on in the officers, anyone who has been in a fire fight knows how that is, but being trigger happy is not an excuse. I think it will be a very expensive lesson for this police dept.
Sounds a bit like that WMD bust that turned up no WMDs… oops. Well we got away with it so I'm sure the police will too.
An all-too-common occurrence, unfortunately, which should surprise no one in a society in which supposedly anti-government conservatives are the biggest supporters of the Patriot Act.
The biggest surprise–and the most hopeful result, for me–is that in this case even conservatives are upset about the shooting of Mexican-born Jose Guerena. Of course if they'd found a marijuana leaf in the house, that would have negated his ex-Marine status for many.
You, Sir, are wasting the air you breathe – most "Conservatives" are (in my experience), and have been, against it.
Nice ad hominem, Ugly, but then by your definition there are no virtually no conservative Republicans in Congress. Only one Senator–Democrat Russ Feingold–voted against the Patriot Act originially. Only 10 Senators–all Dems or indiependents–voted against the Bush reauthorization of it in 2006.
In the House, 62 Dems, an independent, and 3 Republicans voted against it originally; 124 Dems and 13 Republicans voted against its reauthorization. Maybe you should be voting for Democrats.

What I would like to know is how the Police though that this X-Marine had drug. No drugs were turned up, why did they not if they suspected him of dealing drugs find drugs. Where did they get there information. Was he on survillance ? or just had friends that were know drug dealers. Was he gainfully employed .

As a "conservative", I , and many others have always been against the patriot act. The name itself is a farce and pure propaganda. It should be named the Anti-Patriot Act or Revocation of Rights Act. It severely diminishes our constitutional rights and gives the government an astounding amount of power over we the people. No warrant searches, wire tapping, and now murder. Swat teams were developed as a last resort solution. Now they seem to be the first choice on many occasions. Had the marine killed a couple of the Swat Team members and survived I bet they would have found drugs in the house and charged him with murder of police officers. The fix is in. The right to defend our home against criminal invasion no longer exists. The "SS" does exist in the US and it's government sponsored through the so called Patriot Act.

The local county sheriff is the last line of defense of the Constitution at the local level, the county. Dupnik and his cronies need to be tried and convicted, that includes the thugs who raided this man's home and killed him under the pretext of law enforcement. With sheriffs like this who needs the Russians, the Chinese or Jihadists. Dupnik is a greater danger to our Constitution and our safety than our enemies abroad.

This kind of incident is becoming all to regular and wrong addresses are frequent, it doesn't seem to me that any kind of recon and back check are being used to avoid wrong entry exercise. The new interpetation of the patriot law does a way with habeas corpus and kicks the 4th amendment aside, search and siezure can now be done on suspicion or alleged cause. Another right that needs to be reclaimed, my thinking is we have now made the slide down that slippery slope and crossed a very identifiable line.
This country is in very serious trouble within and without….The courts have now given over to the police the right to break the law.
