(CNSNews.com) — The U.S Board of Immigration Appeals has agreed to reopen the immigration case of Onyango Obama, delaying the deportation of the 68-year old Kenyan who violated an order to leave the United States in 1992.

U.S. Immigration and Customs Enforcement (ICE), a division of the Department of Homeland Security, confirmed to CNSNews.com on Tuesday that Obama, who is the president’s uncle, was granted a rehearing last week and his case is being re-opened.

“The Board of Immigration Appeals (BIA) remanded the case back to Executive Office for Immigration Review (EOIR) for reconsideration. It is inappropriate for ICE to offer any further comment on this case,” Brian P. Hale, ICE assistant director for public affairs, said in a statement to CNSNews.com.

The Cleveland, Ohio-based immigration law firm of Margaret Wong and Associates, which is handling Obama’s case, said the delay may allow the Kenyan national to apply to stay in the U.S. permanently.

“We are delighted that the Board of Immigration Appeals has decided to reopen the deportation case of President Obama’s uncle, Obama Onyango,” Wong said in a statement.

The conservative watchdog group Judicial Watch is suing the Department of Homeland Security for records pertaining to President Barack Obama’s illegal immigrant uncle Onyango Obama, aka “Uncle Omar.”

“It’s a Freedom of Information Act lawsuit and it asks what a lot of people are wondering, which is what was going on with the administration and its handling of Barack Obama’s Uncle’s [immigration] status,” Judicial Watch President Tom Fitton told The Daily Caller.

Onyango Obama was arrested in Farmington, Mass. in August on drunk driving charges. In March Immigration and Customs Enforcement (ICE) said they would continue deportation proceedings for Obama, who was reportedly told to leave in 1992, but stayed in the U.S.

According to the Washington Times, after being booked for his August DUI, Onyongo Obama was asked about bail and said, “I think I will call the White House.”

In September Judicial Watch filed a FOIA request for documents from ICE, including “all records of communications, contacts and correspondence between ICE” and the following entities: the Framingham Police Department, the White House, the Executive Office of the President and the Justice Department.

President Barack Obama’s uncle has been granted a hardship driver’s license by the Massachusetts Registry of Motor Vehicles just a week after he lost the right to drive for 45 days in a deal in a drunken driving case.

The license granted Monday allows 67-year-old Onyango (ohn-YAHN’-goh) Obama to drive from noon to midnight to get to work as manager of a Framingham liquor store.

A Registry spokeswoman tells the Boston Herald (http://bit.ly/Hbj3k0) that Obama “met all of the criteria” to qualify for the hardship license, including proof he was enrolled in an alcohol treatment program.

Onyango Obama — the president’s illegal alien half uncle — admitted to sufficient facts today in his drunken driving bust and his case is being continued without a finding for one year — but he must surrender his license.

Obama, 67, was ordered to give up his license for 45 days, effective today, a Framingham District Court judge ruled. He left court without speaking to the press.

Obama had been waging an aggressive legal battle against Framingham cops ever since he was pulled over Aug. 24 for driving erratically and blowing 0.14 on a Breathalyzer. But his attorney today said it was time to move on.

“After a thorough review, we felt it was in his interests to end the matter without any further proceedings. He’s glad to have this behind him,” said Obama’s attorney P. Scott Bratton.

The attorney added that Obama wants to “get on with his life” and to “get on with his normal quiet existence in society.”

Barack Obama’s illegal alien uncle Onyango Obama, whom the president calls “Uncle Omar,” got caught on New Year’s Eve asking for the hair of the dog that bit him. Northeastern talk show host Howie Carr discovered that residents of Framingham, Massachusetts, spied the illegal Kenyan (Omar) drinking in the same restaurant where he bent the elbow before his drunk driving arrest last August, an august tavern known as The Chicken Bone (famous for “Chicken & Tunes”). He must have had a few too many because the media have reported his lawyer will attempt to blame his near-crash with a police cruiser on his arresting officer.

Officer Val Krishtal encountered the 67-year-old just outside the bar when he said Uncle Omar came to a rolling stop and nearly caused an accident. Onyango took a breathalyzer (and not because he’s asthmatic), blowing 0.14, nearly double the state’s legal driving limit of 0.08.

However, he will attempt to blame his reckless driving and well-documented inebriation on Officer Krishtal. According to The Washington Post, Krishtal wrecked his cruiser on November 22 while responding to a report of gunfire. The move is a transparent attempt to portray the policeman as a dangerous driver.

Some things make a driver more inclined to wreck his car. One of them is speeding over the cold roadways of a Massachusetts November while rushing toward your duty to protect an innocent citizen from a shooter. Another is saddling up to the bar at The Chicken Bone and throwing so many back you cannot stop your car when you see a police cruiser driving directly toward you, even though you are currently breaking numerous laws. One should rankle the jury more than the other.

So should Onyango’s behavior since the event. After the arrest, Omar told officers, “I think I will call the White House.”

Onyango is the half-brother of Barack Obama Sr. and the older brother of Obama’s aunt, Zeituni Onyango, who was found to be living in public housing in South Boston and collecting welfare despite being an illegal alien.

Rep. Steve King, R-IA, has proposed Congress investigate why the illegal, who was ordered deported in the 1990s, is still in the country. Just before Christmas, former Massachusetts Governor Mitt Romney told Carr he would order Onyango deported.

The world will be better off when all the Obamas can live together as one big, happy family — in Kenya.

The defense for President Barack Obama’s uncle is challenging the driving record of the police officer who arrested him on suspicion of drunken driving.

Onyango (ohn-YAHN’-goh) Obama, an illegal immigrant, briefly appeared in Framingham District Court on Thursday. His lawyer said he’s investigating whether the officer has a pattern of poor driving.

Officer Val Krishtal arrested Obama, the half-brother of the president’s late father, in Framingham in August. Krishtal said Obama made a rolling stop at a stop sign and nearly caused his cruiser to crash into Obama’s sport utility vehicle.

Krishtal said Obama registered 0.14 on a blood-alcohol test, higher than the state’s legal limit of 0.08.

Obama’s lawyer also is seeking to suppress those results and evidence from the traffic stop.

Mitt Romney told radio talk show host Howie Carr if he were president, he would Obama’s illegal alien uncle. The 67-year-old Onyango Obama, whom the president refers to as “Uncle Omar,” was arrested for drunk driving after nearly ramming a policeman with his SUV in August. Romney, who did not recognize the name at first, said yesterday, “Well, if the laws of the United States say he should be deported, and I presume they do, then of course we should follow those laws.”

The latest Obama family immigration violation took place on Wednesday, August 24, outside a Framingham restaurant and bar known as The Chicken Bone.

Rep. Steve King, R-IA, threatened to call Uncle Omar before Congress, both to question his preferential treatment and to protest the president’s stealth amnesty policies.

“It appears there is a double standard — one for President Obama’s family and one for everyone else,” agreed Texas Congressman Lamar Smith in a press release.

Uncle Omar had been ordered deported to Kenya in 1992.

Obama’s aunt, Zeituni Onyango, also lived illegally in Massachusetts for decades after being ordered deported, receiving public housing and $700 a month in disability benefits at taxpayer expense. She was ultimately granted asylum by the same judge who had denied her petition a few years earlier.

Romney is far from a perfect candidate for president, but this is one area where he speaks for the grassroots of his party.

Lawyers for President Obama’s illegal alien half-uncle are going after the beat cop who busted him on a drunken-driving rap, chasing internal affairs records they hope will paint him as a serial squad-car speeder.

Onyango Obama never would have been stopped and subjected to a breath test, which lawyers also are contesting, if it weren’t for the cop’s bad driving, his lawyers insist.

“It will be our contention that the officer nearly caused the accident by nearly hitting Obama,” defense attorney William L. Harvey III told the Herald, saying he believes patrolman Val Krishtal was going “well above the speed limit” at the time of the near-crash.

Obama’s attorneys said they want Framingham cops to cough up a paper trail on Krishtal, who, according to his own police report, nearly rear-ended the commander-in-chief’s long-lost relative before making the Aug. 24 stop heard ’round the world.

“What’s at issue is obviously the police officer’s course of conduct with regard to his speed, especially on that day he pulled Obama over,” Harvey said. “We’ve learned that there have been numerous incidents in Framingham with regard to his driving pattern as a police officer.”

Republican presidential hopeful Mitt Romney says he would deport President Barack Obama’s uncle, who police say was arrested in August for drunk driving near Boston and is an illegal immigrant.

In an interview with Boston radio host Howie Carr on Wednesday, Romney said “yes” when asked if Onyango Obama should be deported. Romney at first did not recognize the name, but said the nation’s immigration laws should be enforced.

Onyango Obama is the 67-year-old half-brother of the president’s late father. His case is pending in Framingham, Mass., District Court. He was initially held without bail on a detainer from U.S. Immigration and Customs Enforcement officials on allegations he violated an order to return Kenya issued 20 years ago but has since been released.
