The U.S. Supreme Court announced today it would not hear Kerchner v. Obama, a case challenging whether President Barack Obama is constitutionally eligible to serve in the Oval Office.
The case is the latest in a lengthy series of cases in which U.S courts have refused to hear any arguments about Mr. Obama’s eligibility.
The court effectively killed the Kerchner case with one terse statement: “The motion of Western Center for Journalism for leave to file a brief as amicus curiae is granted. The petition for a writ of certiorari is denied.”
“I don’t think the court helped heal the country,” said Mario Apuzzo, the New Jersey attorney who argued the case on behalf of retired Navy CDR Charles Kerchner. “We still don’t know Mr. Obama’s status. … The court is supposed to take cases that are important, and I can’t imagine a case more important than this one.”
“You need justice to resolve conflicts between people, and when justice is denied people continue to go after each other in a savage way. We did not get justice, ” Apuzzo told WND. “For the court to deny our justice sets the country back terribly.”
“This decision did not help Mr. Obama,” Apuzzo added. “It did not bring legitimacy to his office. Mr. Obama does not have legitimacy of office by the court or by the consensus of the nation, because many people question whether he is a natural born citizen. How does our nation go forward with this kind of result?”
“This matter should have been addressed by the media and political parties early in the spring of 2008 during the primaries. It wasn’t,” wrote Kerchner Monday morning. “Congress should have addressed this when asked and when constitutionally it was required to. It didn’t. The courts should have addressed the merits of the questions when appealed to early on. They didn’t. Everyone in our system of government chose appeasement over confrontation and punted the ball to someone else.”
“Now it is far worse,” Kerchner continued. “The Supreme Court has chosen appeasement and inaction over action and dealing with the issue and questions openly in a court of law under the rules of evidence and law. Our constitutional republic and legal system is now compromised and broken.”

Sometimes I wonder about that. Also what you are teaching to our children that we pay money to get them educated. I hope you leave your politics at the front door. They need to be educated and then determine their own views. My Daughter is her last year of her undergrad studies and the week this guy was elected president she told me that her Art History Associate Professor spent the whole week on Obama, which in my judgment is a real piece of art. That is being as polite as I can about this President.
My students know my politics–and the politics of my best friend in the department, a conservative Southern Baptist. I don't believe there's any such thing as an unbiased teacher, reporter or historian, so I make my biases known.
At the same time, in class (unlike here), I do try to fairly present both (or all three) sides of a potential issue, and for my media criticism class, I also choose as a TA the student from the semester before who disagreed with me most often. So my next TA, for example, will be a Evangelical Christian who just took the exam to be a state highway patrolman.
Most of my students are conservative Christians when they arrive here and still conservative Christians when they graduate. I am consistently surprised at how little credit some conservatives give their own college-age children for being rational adults, influenced far more by their upbringing than by anything that they encounter in college. Sometimes I wish I had as much power as some conservatives seem to think I do.
The Senate with 2/3rds votes are the only ones that can initiate Impeachment Hearings. If they don't initiate, then the only thing for the American public is outright Revolution and blood in the streets. And right now I don't think the American Public has the stomach to go "Make Government" responsible by removal at gunpoint. The obama traitors that he nominated and the congress put into the supreme court didn't even recuse themselves from the Kerchner vote like they are suppose to, total abuse of power. But folks, until the people (You and me) decide to take up arms, we are stuck on the down hill slide, unless the senate acts. Obama and the split house, are not going to get this country back to it's conservative roots and in line with Spending and Taxes because of the split house. Actually I didn't finish my statement, on page 16, Article 1, section 3 "the Senate shall have the sole power to try all impeachments."
The states already have "Militia" power, it is called the people of the United States… and the constitution calls under Amendment II the right of the people to keep and bear Arms, shall not be infringed.

I didn't think it could happen here in the USA. Maybe at one time in the USSR. These are things that can bring rebellion when people are denied access in the courts to redress their grievances. This is the underpinning of our form of freedom and democracy . The Court is on a very slippery slope when they issue such a terse opinion. It appears that Obama or his handlers have the Supremes wired too. Be ready for civil unrest in this country on a significant scale.

Is anyone really surprised by the Supreme Court's decision? After all, these 9 judges are nothing more than glorified government employees. Big government has "co-opted" all three branches into one giant ruling class. Each one "protects and defends" the other two. Well, here is the rational as to why Obama nominated Elana Kagan for the Supreme Court…. Pull up the Supreme Courts website, go to the docket and search for Obama.
Acting in the capacity of Solicitor General she represented zero as the attorney of record in suits filed against him, in the Supreme Court, demanding he show proof of his natural born citizenship. He owed her big time. All of the requests were denied of course. They were never heard. It just keeps getting deeper and deeper, doesn't it? The American people mean nothing any longer. Most they simply reject quickly and routinely, as they did this one. The United States Supreme Court has been compromised by having judges seated that have no moral authority to pronounce anything just or unjust . The Obama eligibility case was a tremendous opportunity for the highest court in the land to unite the American people, at least on this one issue. The President's "reign" is suffering under a cloud of illegitimacy which causes the American people to discount what he says and who he is. It also causes great anger to arise when he does things that seem to be at odds with deeply held American values. The Supreme Court had a chance to put to bed the fears America had about its leader but they chose the politically correct, and possibly even cowardly, route. Unfortunately, the American people will have to seek their answers in other ways – hopefully without violence. You failed us, Supremes. But then, you're in office for life, so why should any of you really care about what the rank and file of America is going through?
.Time to start electing Judges, and subjecting them to term limits. This ruling from the bench needs to stop. When you do not defend and protect the Law of the land, the Constitution, that is treasonous. . .

It's a conspiracy of silence and benign neglect perpetrated by jurists, politicians, talking heads and the media to prevent public upheavel should Barack be exposed as the ursurper he most likely is. As they say, we are entitled to our opinions, but not to our own facts. A little objective research into this subject clearly demonstrates that there is sufficient credible evidence to strongly suggest Barack is, in fact and under the law, ineligible. The people deserve a ruling as to the meaning of "natural-born citizen" per the Presidential Clause, failing which we are nothing more than a nation of men and not of laws. No one should be above legal scrutiny. And that includes the Prez and the cowards who fail to objectively address this issue head on.
I agree with you that there is enough evidence to suggest BO is not eligible to be president but I doubt that the motive of the media and some talking heads is to prevent public upheavel. If they had wanted to do that, they would have vetted him before he was sworn into office when there was an outcry about it already going on. I will agree that is probably the reasoning of juristices and maybe some politicians. I've wondered about what would take place at this point should he be exposed as ineligible after he is out of office. Will the legislation he signed be void or will it stand without a president's signature because it was passed by both houses? Will the executive orders he signed that congress didn't vote on stand or be revoked?
If found ineligible after he leaves office, heads will roll big time. No doubt, it would be a serious constitutional crisis, but something we as a nation could weather. Unfortunately, there wasn't sufficient public attention on the eligibility issue during the campaign, and, of course, with no statute requiring that he prove his eligibility and the various secretaries of state cluelessly rubber stamping his eligibility, in the eyes of most at that time there simply was no crisis. However, after the fact, much more came to light and now there is a sizeable portion of the population which is deeply distrustful and cynical. But, I still believe a certain part of the population would literally go bonkers if we managed to toss Obama out on his ear. For the life of me, I simply cannot fathom any other reasons for this conspiracy of silence, cover-up and betrayal. The fear of upheavel is the only think that rings true.

If the Supreme Court is not going to do the job that they were sent to do, then I think that more and more of our military personel should start doing what LtCol Larkin did, Refuse to take ordes from an Illegal Imposter, because any orders he gives are as illegal as he is and it is against the Military Code of Justice for any soldier to carry out any unlawful assignment. This imposter is not a legal Commander-In-Chief, he is a Communist Dicktaster in Charge. Thus, any order given by him holds as much water as a bucket with the bottom cut out of it.

I think it could be for the better that the Supreme Court avoided the birther case because it would very likely be more pro Obama rather than pro constitution. Have no fear folks, I really think after the new Congress gets going in Jan 2011 we will see the House get subpoena power to get the discovery needed on Obama's citizen status. We now have a clear GOP majority there. I really hope that you are RIGHT, but, the more I watch the votes from the Right, I see that they are really Left. Left is never Right. In our State District there are more Rhino's in the Republican Party than there are conservatives. I think the Rights need to invade the Left, but of course, it is hard to fake being a Left because their values are so Liberal. I really see that this is a War between those who hold truth to Christ and those who are Anti-Christ in their belief systems. They want to save the earth and kill the babies. This is an upside down philosophy and moves quickly from social justice or socialism to communism, where they get rid of their opponents, not just vote them out.

It would take a two-thirds vote, and no Dem–let alone close to 20 of them–is likely to vote against the president from his own party. Besides, I'll bet it never comes to a vote even in the House.
And by the way, Nixon was never impeached (though by the time he resigned, it looked like he would be). Clinton was impeached by the House, but not removed by the Senate.

Do you really mean that even if the House votes for impeachment and very convincing evidence is presented at a Senate impeachment trial, "no Dem" would vote to convict? Even if the trial evidence is overwealming and the majority of the people are persuaded?

Doesn't look like the issue will be properly addressed until after Barack is out of office. The judiciary is intimidated by the issue. Why? My guess is that the specter of massive public upheavel should SCOTUS actually muster the courage and integrity to hear the case and to render Barack ineligible is more than SCOTUS can bear. Under precedents set by Reagan, Clinton and G.W. Bush, it's unlikely that Congress could force a president to turn over anything he didn't want to give them.

Consider the consequences. If they had go on to hear the evidence all of the material Obama is hiding would have brought out. Then upon the determination that he was not legally President, every piece of legislation that he signed into law would be invalidated! What would be the consequences of throwing out all of those bills.

I think we can and should be willing to handle those "consequences". Without Constitutional order, a much higher price would be paid by us all, that being the eventual dissolution of our constitutional Republic. So, I opt for the less painful and transitory confusion which may results from our return to the rule of law and rule of the people. Should be a slamdunk easy choice for any American.

It appears to me that this is the single MOST IMPORTANT ISSUE that faces the American people. This president or any future presidents needs to be verififed and qualified before even running for any position in the government. They should be scrutinized more than a regular employee applying for hire. If this one important issue about Obama was addressed "honestly" our country could get behind him but it appears that this country is not about honesty, but about taking this country down a slipery path to something other than Republic for the People and by the People.

This is an unconscionable abdication of judicial responsibility over an issue that has Constitutional ramifications. The Court has used one feeble excuse after another to avoid making a decision on this question, which is clearly within their scope. In the face of every other avenue for relief being denied to a substantial number of people, it's shocking that SCOTUS continues to use flimsy procedural grounds to prevent the question of presidential eligibility from being properly addressed. Alas, the Supreme Court, the People's last, best hope for fair and just treatment, has failed us, too.
