In a stunning move, the U.S. Supreme Court has scheduled another “conference” on a legal challenge to Barack Obama’s eligibility to occupy the Oval Office, but officials there are not answering questions about whether two justices given their jobs by Obama will participate.
The court has confirmed that it has distributed a petition for rehearing in the case brought by attorney John Hemenway on behalf of retired Col. Gregory Hollister and it will be the subject of a conference on March 4.
It was in January that the court denied, without comment, a request for a hearing on the arguments. But the attorney at the time had submitted a motion for Justices Sonia Sotomayor and Elena Kagan, who were given their jobs by Obama, to recuse.
Should Obama ultimately be shown to have been ineligible for the office, his actions, including his appointments, at least would be open to challenge and question.
At the time, the Supreme Court acknowledged the “motion for recusal” but it changed it on official docketing pages to a “request.” And it reportedly failed to respond to the motion.
Hemenway then submitted a request for a rehearing, pointing out that the situation appeared to be violating the rules of the U.S. Supreme Court.

I agree it's their job to interpret the Constitution. Unrelated to Obama's eligibility, or lack thereof, perhaps they should start doing just that. That would mean re-visiting Roe v. Wade, in which the Supremes overstepped their authority and CREATED constitutional law. They correctly left application of the death penalty to the states, but screwed the pooch by hijacking application of abortion laws from them. And maybe they can take another look at the 1st Amendment; that codicil states specifically that "CONGRESS (my emphasis) shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…" The Court's previous decisions have made a shambles out of that portion of the amendment.
As far as eligibility for the office of President, those standards are explicitly laid out in the Constitution. It is well within their authority, and responsibility, to address any confusion or questions arising from them. And since there apparently IS some concern as to what "natural born" defines, it would behoove them to clarify sooner rather than later what that definition entails.

Actually , no . The job of the Supreme Court is to pass on the Constitutionality of laws passed by Congress , not to appease the public . However , I agree that if the public is in an uproar they shouls look at it . If Obama is found to be ineligible wouldn't the Speaker of the House become President in this case? The current VP, Joe Biden, would normally become President but he is an Obama man and with Obama ineligible anyone he appoints is also invalid. John Boehner would then by default (second in line) be President.

How can Obama's two appointees on the Supreme court hear the challenge, since if Obama is proven unqualified for office, their appoin tments would be null and void. I'll believe it when I see it. It takes four (4) justices to "agree" to take the case, but all nine (9) justices participate in the final vote. The two "freaky mammas" should recuse themselves. Elena Kagan represented Obama in eligibility cases and has been his puppet lawyer for some time.
There is no need for them to recuse themselves unless the justices actually decide to hear the case (and probably not then, esp. w/Sotomayor–after all, Justice Thomas has been shown to have much bigger conflicts in the past couple of weeks), though they may choose to recuse themselves from the discussion of whether to take the case (and maybe you think they're too persuasive or the other justices are too wimpy to take a stand otherwise).
The fact is, though, that they're votes didn't matter. Though the proceedings are secret, based on previous courts, with each case brought for consideration, Roberts will bring up the case and ask if anyone things it's worth hearing.
If anyone does, they'll discuss it and then see if there are four votes for it. I'd be willing to bet not one of them even thought it worth hearing–obviously even four most conservative justices didn't.

Wrong, Steve (& Jim). Biden wasn't appointed–like Obama, he was elected. So the only way Obama can be removed is through impeachment (which won't happen). And if he is removed, Biden becomes president and then appoints a new VP (probably Hillary).
I'm no expert but obama/biden ran on ONE ticket as all Presidential hopefulls do. Biden wins ONLY if obama wins. Voter's vote for the TICKET. The Twelfth Amendment specifies that each Elector in the Electoral College (which actually elects the President) gets two ballots: on one they vote for President, on the other they vote for Vice President. Therefore, the Vice President is elected separately. That means, under the U.S. Constitution, if Obama is removed for ineligibility, Biden would be come President. Taking a historical view and considering tthat we've survived–among other things–the Civil War, the Gilded Age, the Great Depression, World Wars, the tumult of the 1960s, and the various corrupt administrations of both sides throughout our history, I suspect we're strong enough survive this, as well.
Libby wasn't elected, of course; he was appointed before he became the highest-ranking White House official convicted in a government scandal since John Poindexter, the national security adviser to President Reagan. Libby paid a big fine, did community service, and was disbarred. Bush communuted Libby's prison sentence–but as one more little indication that these folks ultimately care about the country–Bush didn't pardon him.

Obama is not an usurper. He is a Natural Born Citizen due to his birth in Hawaii. ALL US citizens who were born in the country are Natural Born citizens. Only naturalized citizens are not Natural Born Citizens. That is why Obama's election was confirmed by the US Congress UNANIMOUSLY. Diaz-Salazar v. INS, 700 F.2d 1156 (7th Cir. 1983) (child born in US to Mexican citizen is “natural born citizen” of US):
“Petitioner, Sebastian Diaz-Salazar, entered the United States illegally [from Mexico] in 1974 and has been living and working in Chicago since that time. *** The relevant facts which have been placed before the INS, BIA, and this court can be summarized as follows: The petitioner has a wife and two children under the age of three in Chicago; the children are natural-born citizens of the United States.”
The relevant US Supreme Court Ruling is the Wong Kim Ark case, which ruled six to two (one not voting) that EVERY child born in the USA is Natural Born. When a person is both Natural Born and a US citizen, she or he is, duh, a Natural Born citizen.
The actual words of the ruling were:

Dishonest campaign workers dummied up a Selective Service application for him; his Social Security Number was stolen from a resident of Connecticut; his application for a law license looks like it was done with a crayon! He had so much help making him look like a success story e.g. Bill Ayres writing his biographies, someone very rich buying him a spot at Harvard and then as a "lecturer" at the University of Chicago. Obama was neither adopted in Indonesia (nor in Hawaii, for that matter). Nor did he become a citizen of Indonesia. Both can be confirmed by simply calling the Indonesian Embassy in Washington. Also, he never legally changed his name to Soetoro, so he did not have to change it back.
Also, there was never a lawsuit against Obama just for his birth certificate, so he has not spent any money on hiding it. In fact, he has shown the official birth certificate of Hawaii, and THREE Republican officials in Hawaii have confirmed the facts on it.

I heard that as a child, his step-father took him and his mother to Indonesia, where he attended a school there, eligibility to attend., you had to be a citizen of Indonesia. The evidence is overwhelming and undeniable. Obama DID NOT meet the citizenship and residency requirements as set forth in the Constitution. I have furnished copies of the Hawaiian Certificate of Live Birth (this IS NOT the long form Hawaiian birth certificate) and copies of the true Kenya Birth Certificate to members of Congress. If the two Obama appointees are not recused then a fair and impartial hearing and decision on elligibility of the president would not be possible.
There is no need for them to recuse themselves unless the justices actually decide to hear the case (and probably not then, esp. w/Sotomayor–after all, Justice Thomas has been shown to have much bigger conflicts in the past couple of weeks), though they may choose to recuse themselves from the discussion of whether to take the case (and maybe you think they're too persuasive or the other justices are too wimpy to take a stand otherwise).
The fact is, though, that their votes didn't matter. Though the proceedings are secret, based on previous courts, with each case brought for consideration, Roberts will bring up the case and ask if anyone things it's worth hearing.
If anyone does, they'll discuss it and then see if there are four votes for it. I'd be willing to bet not one of them even thought it worth hearing–obviously even four most conservative justices didn't.

Though I'm not an attorney or legal scholar–and people who are legal scholars have been disagreeing about the issue since Nixon– I find that unlikely that the president could be put to trial anywhere other than via impeachment proceedings, as that would create a separation of powers problem. And I suspect that Obama wll be long out of office before the courts reach a conclusion on the issue, if they ever do.

In America (not Switzerland) at the time that the Constitution was written, the phrase Natural Born was with minor exceptions a synonym for native born, which was not a popular phrase at the time. Natural Born was used very frequently, and it ALWAYS was used in America to refer to citizenship due to the PLACE of birth. It never referred to parents at all.

Instead of quoting someone's view of the tenets in the Constitution, why not just quote the Articles themselves? They are short and quite to the point. Now I don't know who Rawle is or was but I do know I didn't see his name as one of the signatories.
The article you are referring to says:
"No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States."
And the meaning of Natural Born in America (not Switzerland) at the time that the Constitution was written referred only to the place of birth, citizenship due to being born in the country–not to the parents of the citizen. Not one single writer of the Constitution or any other American leaders at the time including Hamilton and Jay and Adams ever used the phrase Natural Born to refer to the parents. They only used it in the same sense that it was used in the common law–to refer to citizenship due to the place of birth.
