A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama’s eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.
If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.
In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.
In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party’s chairman, were restored as plaintiffs.
But the judge did not immediately rule on Taitz’ motion to be granted discovery – that is the right to see the president’s still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz’ challenge to the work of a magistrate in the case.

Thank you for the news. Please try to get this case out on the internet and news as much as possible. The fact that that no news media that is very large is covering this case speaks poorly for America. The fact that Obama will not release records that are required for secret clearance or for most higher level jobs is disgusting.
Thank you for this wonderful news, I will send this information to all of my family and friends as we all have been praying that Barack Obama's eligibility to be president would be investigated to find out if he was in fact qualified to be president of our United States of America under the rules and regulations of the U.S. Constitution, and since he has refused to furnish his personal birth certificate and other important documents needed to prove his eligibility, it causes the citizens of the U.S. to wonder if he qualifies to be our president, wheather we voted for him or not.

It's about bloody time! FINALLY!!!!!!!!!!!!!!!. There is proof that Obama is not to be President. He was NOT born in America. The Colonel said it right. I believe that Obama should be made to produce the legal documents of his birth, education and whatever else is needed to make him qualified to be president of the US. He is not my president. We do not need all the illegal aliens and terrorists that Obama wants to bring in to the country and take benefits from us Americans who have defended our country and died for our country. Impeach him if he is not legal to be a president and even if he stays he still won't be my president.

Yes it is sad that this Obama refuses to show his documents…and it is sad that so many media outlets refuse to report facts but lobby for Obama.. BUT the sadest part is the American people = they knew all this in 07 and 08. Certificate could be checked against other certificates of the same period. they'd have to get old paper, old ink and the same machine or hand writer to forge document so it duplicates others of the same time period. Damn near impossible.

Why doesn't anyone ever point out that the Justice Department is part of the Executive (presidential) branch of the Federal Government? It is NOT the same thing as the Judical (Supreme Court) branch. This is exactly the same ploy that was used by the Clintons to keep them from being prosecuted – that is have the lawyers appointed by the president decide what to do about matters involving the president. Conflict of interest? Surely not.

I am glad the case was not dismissed. I hope the case is ultimately decided on the Constitutional merits.
Until then I will not presume Obama is eligible or not, although I will say that it is suspicious, and it makes Obama look bad, that he won't produce the Hawaii birth record.
In the mean time, I can do 2 things at once: 1) I can respect the Office of the President, and 2) I can also be very much opposed to Obama's politics
Can somebody tell me why the U.S. Government is fighting this case on behalf of Obama. He should have to use private attorneys for this. Good job to all of those who were persistent in pursuing this. Hopefully all the truth will come out and justice will be done.
