Two months ago, Barack Obama decided he could intimidate the United States Supreme Court into finding his namesake healthcare plan Constitutional. Overturning the Affordable Care Act “…would amount to an unprecedented, extraordinary step of judicial activism” said the President at a rare White House news conference, adding “…I’m confident that the Supreme Court will not take what would be an unprecedented extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress.”
Though someone with the hyper-arrogant mentality of the Manchurian Candidate doesn’t really need a reason to direct this sort of psycho-babble at a presumptive enemy, Obama was probably responding to information provided by far left Justice Elena Kagan that the Court’s closed-door, preliminary vote on ObamaCare had not gone very well. Each Friday, the 9 justices gather for an initial vote on the cases heard during the week. And although these weekly conferences are to be strictly confidential, it’s a safe bet that Obama’s Court stoolie was on the phone with the White House minutes after its conclusion.
However, as this preemptive strike on the court was met with a nationwide flurry of criticism even from a number of his media supporters, Obama made no further reference to the prospective ruling.
But on Monday, a new county was heard from. Dedicated leftist Senator Patrick Leahy directed a 2000 word dissertation at the Court from the Senate floor, selecting as his principle target Chief Justice John Roberts. “The constitutional challenge to the Affordable Care Act is the current instance in which narrow ideology and partisanship are pressuring the Supreme Court to intervene where it should not,” claimed Leahy, making clear his view that the Court has no business interfering with a Congressional assault on the Constitution. The senator advanced the 2000 Bush/Gore decision as an example of the sort of “judicial activism” that “shook the confidence of the American people in the Supreme Court.” He ridiculed conservative justices for their tough questioning of principle ObamaCare advocate Solicitor General Donald Verilli during oral arguments, stating “their action will not help restore American’s confidence in the Court to fairly apply the law.”
And he alternately praised and threatened the Chief Justice, literally claiming that if Roberts joined other conservatives in a 5-4 decision against ObamaCare it would “…undoubtedly further erode the reputation and legitimacy of the Supreme Court.”
But what prompted Leahy’s sudden decision to lecture the Supreme Court as to its proper role in government? Was it a last ditch effort to intimidate justices into finding ObamaCare constitutional? Or has Kagan perhaps advised Democrats that Roberts is “wavering” a bit, leading Leahy to believe his misguided, nonsensical claims might persuade the Chief Justice to decide in favor of passage?
Since its enactment in 2010, liberals have believed the Affordable Care Act to be a sure thing to pass Constitutional muster. They were stunned when Justices took offense at the law’s contempt for individual liberty during oral arguments. After all, how could forcing Americans to purchase something they don’t want be unconstitutional if it’s for their own good!
If 5 Justices rule the ObamaCare individual mandate unconstitutional, the American people will hear a wailing and gnashing of teeth unequaled since the pro-Gore efforts of the Florida Supreme Court were undone after the 2000 election. We will be in for some very entertaining days.

Obama and Leahy are idiots if they think they can intimidate SCOTUS the way they do the media, and the way they attempt to do to Congress. Threats and intimidation directed at justices will hopefully work against Obama’s interest in preserving Obamacare’s mandate. I’ve read that Chief Justice Roberts is even considering looking into Obama’s eligibility, and the more Obama threatens him, the more likely Roberts is to insist on the truth.

It’s time for the SCOTUS to just go ahead and define NATURAL BORN CITIZEN once and for all. If they define it as the framers of our Constitution intended – a person born of two citizens of the country in question – they have to throw him out because neither his father nor his stepfather was ever a citizen of this country. Our Constitution states specifically that the President must be a NATURAL BORN CITIZEN, unless he was a citizen at the time of the adoption of the Constitution. Why is the SCOTUS ignoring this provision?
It’s about time the Supreme Court “looked into Obama’s eligibility”. As a matter of fact, that should be done before they rule on Obamacare, because if they find him ineligible to even be president, the laws and executive orders are all null and void anyway.

If a law is deemed unconstitutional by the SC, it is not judicial activism. It is doing what the court is supposed to do.

Leahy’s screed on the Senate floor makes for a very interesting read, providing remarkable insight into the workings of the leftist mind. Threatening the Chief Justice with responsibility for destroying the legitimacy of the Supreme Court should he rule in a particular way on ObamaCare is disgraceful, but typical of the likes of Leahy.

Of course she is, and that was the reason he nominated her for the Supreme Court. I still say she would be impeached for refusing to recuse herself from the Obamacare case. As Obama’s solicitor general, she worked on the law, defended the law in the lower courts, and should have recused herself on SCOTUS. But she refused to do so, and Chief Justice Roberts refused to challenge her, so that makes me think he was trying to pacify Obama.
Roberts was not trying to pacify obama. I’ve watched Roberts closely since he became Chief Justice: He is simply too idealistic. He truly believes other justices will do the right thing in each situation.
It may be a good idea for Sen. Leahy took take a look at the polls regarding the popularity of Congress. It is now in single digits. Leahy’s rantings are one of the reasons the Congress is viewed so dismally by the citizenry they purport to represent. On the other side of the coin, the SC continuously receives high ratings. Leahy is just another lib who can’t conceive of being wrong when it comes to the Constitutionality of a piece of legislation.

We know from where Leahy and most of the Senate get their marching orders, from Obama and those behind him, the American people are not a consideration. Dick Cheney, when he was Vice President, told Leahy to go f— himself and it’s time for us citizens to shout that loud and clear. Obama did something to get a Chief Justice to administer the POTUS oath to an obvious usurper. If I know he’s not eligible you’d think Roberts knew. They’re already compromised. They will uphold some aspect of Obamacare. Thereby giving Obama backdoor eligibility without ever entering the eligibility issue as Scalia said. We’re avoiding that issue. Obama can claim that he must be eligible because they would never have ruled any part of Obamacare constitutional if they knew he was not. Then he will claim that the Romney ticket especially if it contains a Rubio or Jindal is ineligible because they are not Natural Born. Do not doubt me, he’ll suspend or invalidate the elections. Even worse, when the SC does make a bad ruling–and it has made many over 200+ years–if it somehow ASSISTS the left, it should be left in place!! Look at the Wickard v Filburn ruling from one of the lib, New Deal Roosevelt courts. That began the ludicrous exercise of commerce clause power which has done so much to destroy the US. It should be overturned, but Leahy and others would have a fit!

Let’s see, my understanding says it’s against federal law to treaten the president, and I believe individual states have similar laws protecting ALL citizens from threats. Of course, it’s the threat of death or bodily harm, family, etc, but what gives the president and these elected officials their presumed right to make the veiled threats against these justices? If memory serves me correctly, the liberals are the ones who have recently CONFIRMED all the new Justices after the confirmation of Roberts and Alito! The integrity and intellegence of these justices goes beyond the petty political garbage of the likes of Sen. Leahy (who is a prime example for the enactment of term limits) and the president himself! Twenty-six years in the military as a CWO taught me to never burn a bridge!
In a way, when Leahy threatened Roberts that his ruling would destroy the legitimacy of the Court, it was WORSE than a physical threat. The Court depends on credibility and legitimacy, not for the authority of its rulings of course, but as a co-equal branch of government. Polls show Americans have far more confidence in the court than in congress. Maybe that’s why Leahy is threatening the Court with a loss of legitimacy. He doesn’t like the fact that a rubber-stamp for leftist legislation is NOT what the American public wants.

When they were ramming this down the peoples throats, they swore that it was not a TAX. Then in their initial challenges in the court, they swore that it was a TAX. Then they abandoned that strategy and once again declared that it was not a TAX. The bottom line being, if they had passed it as a form of TAX it would not fall under the discretion of any court until a citizen was actually forced to pay such a tax in 2014.
The American people are already paying a mandatory Health Insurance Tax, the IRS calls it the “Medicare Tax”, which at a specific age forces every citizen to participate in their plan and forces them to pay monthly premiums. These premiums + all taxes paid in over a workers life time cover 80% of medical cost. This results in one having to purchase a private supplement policy to cover the remaining 20% ($200 +), with the clincher being if Medicare does not cover a procedure, the supplement does not have to pay anything.
Under Obama’s plan for creating appointed “Panels to Ration Care”, this means that their is no guarantee that the elderly and disabled will qualify for medical treatment, however they are still forced to pay the Gov the Medicare Tax all their working lives, plus the Premium, and the supplement premium if they wish to keep it if they do qualify for some treatment later.
The bottom line here is two fold, the workers are not only forced to pay the life time tax for Government medical insurance, they are also required to pay for private insurance. However, when they reach the age when most will most likely need it, they may not qualify to get treatment due to rationing from the “Panel”. Although you will still be forced to pay for the chance that you might qualify. This makes it more of a “Mandatory Health Care Lottery” than an “Affordable Health Care Act”.
In short you are required by the government to buy a service from a private industry that the government may decide that you do not qualify to receive; at their own discretion at any given time. Although the government forces the private industry to cover your treatment no matter the total dollar amount, they may also determine you do not qualify for the actual treatment meaning the private industry is then required to pay NOTHING; where before they were forced to pay up to one million dollars..

Senator Patrick Leahy is also known as leaky Leahy as he leaked classified docs during Iran-Contra hearings in DC. If he didn’t like it he leaked it. He was forced to give up and to resign his Intelligence Committee post after he was caught leaking secret information to a reporter. Leahy actually threatened to sabotage classified strategies he didn’t like. Leahy’s leak cost the life of at least one Egyptian operative involved in the operation.

I’m probably giving the Dems too much credit for “thinking” but perhaps they are aware of what happened in Honduras when the elected President over-stepped his bounds and tried to change their Constitution so that he could stay in office after his term was up. The Supreme Court of that country ordered the Military to arrest the President, and they ejected him from the Office, and also from the Country. At the time, the Obama Administration and Obama regime verbalized support for the PRESIDENT, not the people of Honduras who were outraged because he was trying to become a Dictator. They showed their true colors on that issue. I doubt that our Supreme Court Justices, as a whole, have THAT kind of guts, strength, courage and character. I wrote a letter to Chief Justice Roberts, before Obama was inaugerated, asking him to verify and demand that Obama produce his Birth Certificate, his Passport, and explain why he has a Social Security card issued in Connecticut when he never lived or worked in that state. I begged him to verify who the man is before he inaugerated him He ignored it, as did everyone else.
What we are really witnessing is a planned dissolution of our government. There are fools in both houses of the Legislature as well as in the Judiciary who simply do not know, or do not care about the founding documents of this Nation. They are quite willing to trash the ideas that made us the most powerful nation in the world. Senator Leahy is quite obviosly one of these people. He would do well to back off and let the Supreme Court do its appointed job. This Obamacare was highly contentious even as a Bill before it was speedily signed into law without its contents ever being released. Over the intervening months, many experts have had opportunity to study the Law and fiind it not to be what it was purported to be. It is highly destructive to the society from a health care standpoint and from an economic standpoint. It was obviously designed to exert progressive control over the people rather than to truly provide increased, improved affordable health care. In other words, it was and is a sham to exert unprecidented government control over every aspect of the lives of Americans, including the so-called death panels which were so vehemently denied by the Democrats. This attack by Senator Leahy on the Supreme Court with the support of many other Democrats shows the real attitude and desire of the Democrat Party, which are diabolical, subversive and speak for a marxist dictatorship to replace our Republic. What these liars overlook is, the fact that a great majority voted for this law. NOT so, it barely passed. And, there are all kinds of things in this law that have absolutely NOTHING to do with health care. Like the additional tax you have to pay if you sell your home, nor the limits that will be placed on Medicare. I don’t qualify for Medicare for another 3 years, by which time I won’t be able to AFFORD medicare. I draw $830 a month, have no other income, so no way can I pay $276 a month premium for Medicare coverage. Not & keep a roof over my head, food in the house, & electricity too. IF this is not struck down, then God help all of us senior citizens. Plus Obama has threatened the Supreme court with gutting Medicare, placing an even bigger burden on seniors.
The sacred mandate of the Supreme Court is to ENFORCE THE CONSTITUTION. If they won’t enforce it, what function are they serving at all?

The arrogance of both Leahy and Obama is amazing. No decision has yet been made by the SCOTUS in regard to Obamacare/Affordable Care Act. It seems that they are directing the SCOTUS what to do.
Such audacity should be met with retaliation by the people. There must be a way to pass term limits. Career Politicians is not what our founding fathers had in mind. We need Senate and House reform as well as entitlement reform and we need it quickly.

I think the Court should listen to the will of the people this time regardless of what Kagan says, she should not be on the Supreme court to begine with, she is totally against the constitution and all for shariah law.. She has spent the last 30 years openly advocating for the destruction of the US Constitution and openly advocating for Shariah law, even accepting 20 million dollars from propponants of shariah law to do so. The speaker of the house said it had to passed before we would know what is in it. 65% of the population do not want it, and the president lied when he said our present healthcare costs would not be affected. They laud about the 2 provisions that may or not be good, that is keeping your kids on your insurance until they are 26 and the exclusion of pre-existing conditions; these in fact has caused premiums to rise and some people to lose their healthcare. The biggest travesty was feeding the CBO the wrong information to get the target cost when in reality the cost doubled.

Everyone in the Supreme Court, Senate and the House do not want to define a “natural born citizen” because that would mean a lot of work for all of them. If obama was to be found not constitutionally the POTUS, that would mean that everyone he appointed and every piece of legislation would be null and void. Every person would find that he/she no longer held a job in government and would have to be replaced. Every piece of legislation would be null and void and every thing that that law affected would have to be redone. That would mean a tremendous amount of work to find those things affected and remedy it. Every body that put obama up for office would possibly be found guilty of fraud or other crimes. Finally since obama was not eligible, the entire democratic party that ran for that office would not be president/vice president. What would be done? It would appear to me that either the Republican Party or other people who ran would become president. Who would that be? Or would our country have to have another election. If that would be the case, Holder would not be the Attorney General since obama appointed him. So that would probably have to be the outcome, a new election. That alone would be a tremendous amount of work setting up.
