On Fox News Sunday, Supreme Court Justice Antonin Scalia expressed his opinion that, while the Second Amendment does secure the right of the individual to keep and bear arms, there are certain reasonable limitations upon this right.

the second amendment cannot be infringe some how hiliary clinton can infringe it why isnt the supreme court sending her to court to judge her and place a stop to her selfish ways.
I personally believe that, while some conduct regulations are reasonable under the Second Amendment (for example, openly brandishing a loaded weapon on a public street), there should be no restrictions whatsoever on the arms a citizen chooses to own, so long as said weapons stay on his or property and do not directly jeopardize the safety of the neighbors.
How about the law is to be written so that if there is a VICTIM there is a crime. What you state has no victim. WHO is damaged by someone openly brandishing a weapon on the street? Why should my weapons stay on my property? If I’m a hermit maybe but I go to town and want to have PROTECTION with me!
This would be a very polite society if everybody was packing heat. Especially if everybody was educated, trained and qualified to use their weapons. Of course, felons and the insane would be disallowed to carry. If you study mass murderers, they only go after the “sheep” who are unarmed.
@Joel – How about when you are on that public street stopped at a red light and someone walks up to your car with a gun and robs you, shoots you and steals your car. Would it be OK in your opinion to brandish your own gun before or after your dead?
To The Honorable Justice Scalia, there are enough laws on the books for gun control, the problem is it only applies to people that follow the law. The person that breaks the law will not follow more laws. The people have the right to keep and bear arms. Who your honor are the people to turn to now that even the supreme court are against us, such as with the ruling on obamacare. The court bent the law saying the mandate is a tax. So your honor, I say that when the highest court in the land does not follow the Constitution, there is no law, therefore it is up to the people to change the government back by any and all means to bring this counrty back the Constitutional law.
d120965, please do not be so hard on Scalia because he was on the opposite side of those in the supreme court who voted to make ObamaCare legal. Scalia was adament that he believes the other justices made a mistake by ruling the penalty was a tax. It is clearly a penalty. Justice Roberts is an idiot who, like John Boehner, wants to get along with the Democrats. Remember Roberts just sit quietly at Obama’s State of the Union address to congress, when Obama criticized the Supreme Court. If Roberts had any gonads, he would have walked out of the State of The Union function. This was the first clue where Roberts’ loyalties stood. Another clue was when everyone wanted Kagan to recuse herself because she was heavily involved in the process of getting ObamaCare passed as Solicitor General. Roberts defender her very wrong decision to not recuse herself from the ObamaCare court case. Roberts and Boehner presented themselves as conservatives, but actually they are RINOs who just want to live off the system.
@Bob202, I do know how Scalia stands, but the points are still the court decided the mandate was a tax, the court is there to decide if it was constitutional, not to make a ruling to have it pass as a tax. The second point was gun control. As I stated if you follow the law more laws are harmful. If you don’t follow the law, making more laws are useless. If the gun control laws already on the books were enforced, and instead of a slap on the wrist sentence we would not need more laws. Prisons are full of lawbreakers, that are in and out, and once out do the same or worse crime over and over again. So enforce the laws, but make them a punishment so that when you do go to prison you’ll never want to go back.
The country club hands off imprisonment that has come creeping across ths country is appalling. I wish i had the full gym that prisoners have access to. they want something to lift? Have em busting rocks and lifting them. Cruel and unusual punishment? tell that to their victims that are now disabled or dead. Why are we spending upwards of 90,000 dollars a yr pr inmate to house and maintin them? that isnt getting spent on their victims.
and what about the people in there for NON VIOLENT crimes. Or crimes that had no victims? Such as a bag of weed? Be serious and make a distinction.

I cannot believe that this pile of garbage came out of justice Scalia’s mouth. I had believed he both understood the constitution and stood firm on the second amendment. This “i am the joker” Bullshit from the creep in Colorado and then a dumdass copy cat in maryland are 2 very isolated incidents. 1 ended with many people killed or injured sadly because the theater owner declared no guns allowed so shall carry permit holders had to leave their guns in the car. This “gun free zone” crap has nationally shown that it only encouraged and emboldens those that are bent on killing and destruction. To me all these incidents do is enfore the ned to get rid of gun free zones and loosen the red tape strangle of getting a shall carry permit for a citizen that has never committed a felony is not under direct mental health care and deemed unfit to carry for such. The Second amendment makes it clear that the people are the well regulated militia. Common weapons used for hunting and target shooting have their roots in military arms. An “Assualt weapon” is any weapon used to cause bodily harm to another IE a good sized cast iron frying pan. The BS of the “Ugly Weapon is an assualt weapon is so redicuous it isnt worth mention but has to be because of dumb socialists that the Democrat party has become the front for.
One way or another, we will be in a civil/race war within the next 6 mos. Probably sooner if the Imposter gets his way. Once things get sorted out, We The People will need to insure that the Constitution is religiously adhered to. Many of us most likely won’t be around by the time it’s all over so it behooves us to educate and instill to our children the necessity to follow what our forefathers left us. God, Guns and Family! I have lived a fairly long life and will have no regrets giving my life to save this country from the enemies within.History books will not have our names, just the fact that a few real Americans took back freedom from a government that allowed a tyrant and his underlings to rule us.

The founding fathers believed that we should be able to have the same weapons that the MILITARY can carry. So we should be able to have all these modern weapons the military uses on his person. If the military carries 100 round magazines and full autos then we should have them too. We should be able to defend ourselves from others that have the same weapons that are using them against us. I think we need to have stinger missiles in our closets with lots of ammo and a good SQUAD auto weapon. JUST LIKE SWITZERLAND.
The Constitution, gives us the right to bear arms and to protect ourselves against the enemy, DOMESTIC or foreign. It does not qualify WHAT KIND of weapons citizens may have. Our forefathers meant for the citizens to have weapons to protect themselves against TERROR! We Americans, will not accept any qualification of the Second Amendment. We are meant to have whatever we need to protect ourselves, be it even tanks or machine guns. Our forefathers did not intend us to only having minor hunting weapons to kill a few bear, dears, or buffalo. They meant our weapons to cause HARM!!! Do not DARE try to amend the Second Amendment that you have already TRAMPLED!! Americans will protect themselves against the terror and you can guess who that may BE!!! Every American should read and know US Code Title 10 Subtitle A Part I Chapter 13
Subsection 311. Militia: Composition and classes
Subsection 312. Militia duty: exemtions I will list 1 exemption, there are more.
(3) Member of the armed forces, except members who are not on active duty.
So, US Code informs us that we the people are the Militia, and not the armed forces. Thus, we should not be subjected to gun control legislation. We the American civilian population are expected and duty bound to protect our nation all the time.
What is it about “Shall not be Infringed” is so hard to understand?
Definition of Infringe:1)Transgress;Violate 2) Encroach ; Tresspass . Transgress: 1) to go beyond or over(a limit). 2) to act in violation of (a law) or commandment. Encroach: (this is the one everyone seems to dismiss,the most important) To take another’s posseessions or “Rights” gradually or steathily! I consider this to be important as to any other laws they try to pass to abate the Second Amendment,such as stopping the sale of on-line ammunition or stopping the sale of certain (types) of weapons .
The Founding Fathers envisioned the future and knew that politicians would become ravenous with power and would someday try to abuse the power and the American people. They inserted certain language into the Constitution that would prevent this. Words and phrases that could not be construed with another meaning. Words and Phrases that meant onething and onething only.
Justice Scalia, a smart and level headed jurorist whom I agree with most of the time, seems to be taking the side of “:A living and breathing Document” (that must be interpreted with the present time period) when it comes to the Second Amendment of the Constitution. This is extremely disheartening. If Justice Scalia can be swayed into this interpretation, who’s next?
In the Revolutionary War the colonist weapons were about equal to those the English Army were able to use, although the English probably had access to more weapons. When the Founders wrote the Constitution and the Bill of Rights, including the 2nd Amendment, they did not put any limitations on the Rights of citizens to bear Arms because that Right was to enable citizens to defend against government tyranny–not just to defend themselves against each other or to hunt game. How are citizens supposed to fight against a tyrannical government if we have pea-shooters against a government that is a military super-power? All gun control laws that have been written and imposed on citizens, are unconstitutional. Scalia is wrong. And, that is just another example that Justices, judges, Senators, Representatives, and even Presidents can mistakenly, or deliberately, misinterpret the Constitution taking Rights away from U.S. citizens. We, the People, the only sovereign Authority in America, MUST make our voices heard.
Scalia is right, what do they have to fear,NOTHING! When we get a crazy one on the high court we have it forever! So it seems we at least need a term limit on the high court too, but so games can’t be played make it twenty or twenty five years so at least they will have something to fear! When you have nothing to fear you can do any crazy thing you want! term these Idiots too!
I am SHOCKED ! Scalia of all people to say such things ! He should know better ! Even permits to carry is Treason – they are infringements ! Founders made ti law that there were to be no infringements, regulations, licenses, etc on guns !

Perhaps certain reasonable limitations should be placed on our treasonous Supreme Justices.
The Second Amendment is not about guns, it’s about OUR rights to protect ourselves and our families.
Scalia and other like-thinkers are really going after our right to protect ourselves in light of the up and coming revolt against government. They believe, if they take our guns away, we will be easily subdued. There are a host of other means to protect and defend. We The People WILL fight for Liberty with any means possible. We are not as stupid as they think we are.
