I suspect this is why Rubio has been dancing around the question insomuch that he knows that this will or could be a problem for him.
I have read the Constitution and and the only mention of eligibility is “natural born” but it does not describe the meaning of the term. Rubio unlike Obama can prove without a shadow of a doubt that he was born in the USA.

This is why neither Obama or Rubio are eligible to be President or Vice President of the United States.
Back in 1875, the United States Supreme Court, in Minor v. Happersett, ruled that:t a “Natural Born Citizen” was defined as children born of two U.S. Citizens.– regardless of the location of birth.
Obama’s problem, by his own admission and records of the State Department is this: Obama’s father was not a United States citizen.
Therefore, via Minor v, Happersett and the United States Supreme Court in 1875, Obama is ineligible because, since his father was not a U.S. citizen, Obama is not a natural born citizen.
For a person to run, as his or her party’s nominee for President, the party must issue certification that the person named is eligible under the United States Constitution to become President. Because the Constitution does not specify the definition of “Natural born citizen” it was left to the United States Supreme Court which, in 1875, defined it as a person born in a country of parents who were its citizens and, like Obama, Rubio’s father was NOT a U.S. citizen, neither was Rubio’s Mother.
Therefore, Rubio is ineligible so sayeth the United States Supreme Court and if Liberals and the News media care to attempt to label the United States Supreme Court of 1875 as right wing nut jobs…so be it and good luck with that.

ABO…..I have supported Romney through most of his campaign but I am upset at his apparent support of Rubio on Rubio’s “Dream Act,” which is another Romney flip flop and I have called him on it by emailing his campaign office. It IS a “slap in the face” of conservatives delivered “full face” by our potential nominee. I advised him that if he keeps it up, I will support Ron Paul at a convention if it comes to that even though I have not supprted him up to now.
We are financially supporting non working or low paid illegals with our tax dollars and thus putting our states and cities in a financial bind. Then we are allowing better paid (and there ar a lot of them) to take jobs away from citizens who are losing their homes. I ask you: Who deserves our loyalty more? Illegals who knowingly broke our laws (“they only want a better life for themselves and their children”) Or our citizens “who only want a better life for themselves and their children.” Who do you choose?
As independents my family and I who are going to vote republican would simply not vote at all if amnesty Rubio is the VP candidate. With the large number of citizens of all colors unemployed struggling to feed Their families and the returning vets who need work…We Do Not Need or Want Amnesty in any way shape or form. Those who are here illegally should be deported and birthright citizenship must be given only to those born here whose mother is a citizen or here legally as it will be impossible to check on who the father is and that would quickly become just another scam. Jobs and benefits of any kind rightfully belong to our citizens not those who ignore our laws to come here and take advantage of our country and its taxpayers!
Although the name of Florida Sen. Marco Rubio is mentioned more than any other as a potential GOP vice presidential candidate, a document found in the National Archives raises questions about whether the popular U.S. senator is actually qualified constitutionally to serve as president or vice president.
The Petition for Naturalization on behalf of Mario Rubio, the senator’s Cuban father, has been retrieved from the National Archives and posted online by the PixelPatriot website, confirming that Marco Rubio was about four years old when his parents became U.S. citizens. Specifically, Mario Rubio was naturalized as an American citizen in 1975, based on the Sept. 9, 1975, date on the petition; Marco Rubio was born in 1971.

So why would all this matter insofar as the senator’s eligibility to serve as vice president? The question is whether Rubio is a “natural born citizen” – constitutionally required of all presidents – a unique citizenship status defined by the Founding Fathers, according to many legal experts, as being the offspring of two citizens of the country.
Of course, the same question has dogged Barack Obama since before the 2008 election and continues to this day. While Obama claims to have been born in Hawaii, the birth document he released with great fanfare at the White House in April 2011 has been determined by multiple document experts as well as a six-month law enforcement investigation almost certainly to be a forgery.
Yet even if Obama could document a Hawaii birth, he still arguably would not qualify as a “natural born citizen” of the United States since he was not born of two U.S. citizen parents, Obama’s father having been a Kenyan national.
Compounding all the controversy over presidential eligibility is the fact that the Constitution does not define “natural born citizen,” requiring legal and historical research to determine precisely what the Founders meant.
Attorney Herb Titus, who has taught constitutional law for nearly 30 years and was the founding dean of the College of Law and Government at Regent University in Virginia Beach, Va., says the “natural born” language was used because the Founding Fathers wanted a leader without divided loyalties.
“That’s precisely what a natural-born citizen is,” Titus said in a YouTube video, “one who is born to a father and a mother, each of whom is a citizen of the United States or whatever other country they’re claiming natural-born citizenship in.”
His explanation:
Concerns over the loyalties of the commander-in-chief were raised in a 1787 letter from John Jay to George Washington.
Wrote Jay, who later became president of the Continental Congress and the first U.S. Supreme Court chief justice: “Permit me to hint, whether it would be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American army shall not be given to nor devolve on, any but a natural born Citizen.”
In fact, Congress in 1790 defined “natural born citizen” as a child born of two American citizens, but the law containing the definition was repealed several years later.
“The Law of Nations,” a 1758 work by Swiss legal philosopher Emmerich de Vattel, was read by many of the American founders and informed their understanding of law later established in the Constitution.
Vattel specified that a natural-born citizen is born of two citizens and made it clear that the father’s citizenship was a loyalty issue.
Explains Vattel: “The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. … In order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country.”
Also, in 2008, when the U.S. Senate resolved that Sen. John McCain, R-Ariz., the Republican presidential nominee, was a natural born citizen, it specified that his parents were American citizens at the time of his birth.
The non-binding resolution, co-sponsored by then-Sen. Barack Obama, stated that McCain – born to two American citizens on an American military base in the Panama Canal Zone in 1936, “is a ‘natural born citizen’ under Article II, Section 1, of the Constitution of the United States.”
The Article II Superpac posted an analysis arguing that the parents of a “natural born citizen” must be citizens at the time of his or her birth. The organization noted that Supreme Court rulings suggest the term applies only to those born on U.S. soil to citizen parents.
Joseph Farah, founder and CEO of WND.com, also has argued that the definition of “natural born citizen” excludes Rubio.
“Rubio is, quite simply, not a ‘natural born citizen’ by the accepted legal, English-language standard as it has been known throughout American history. He was born in Florida to two non-U.S. citizen parents,” he wrote.
“I know this is not a popular notion among Republicans, just as it wasn’t among Democrats when challenges were made to Obama. However, the Constitution should always trump political expediency.
“This is not a ‘technicality,’ as some might suggest. If we don’t adhere to the Constitution on matters as significant as presidential eligibility, then the Constitution ceases to be a meaningful document for guiding our nation. Indeed, it becomes the kind of ‘living document’ that many liberals have claimed it should be – ever-changing to new circumstances,” he said.

Send email to Hannity at Fox News and tell him that you will not vote for Romney if he picks an INELIGIBLE Marco Rubio. In the video above, Hannity didn’t seem to “get it” when Farrah said Rubio is not eligible. He better get it now because, as Constitutional conservatives, we cannot vote for Romney with Rubio on the ticket.
Why I No Longer Respect Marco Rubio
Most people look for a ‘Bandwagon’ to jump on during the political season. They pick their guy or gal and they’re glued on that wagon for the duration of the parade. This works for the ‘who’ most people personally believe would make a good President or Vice President. When the parade is over and the POTUS candidate is obvious, we cheer then for our VP choice, our personal best person to help the ticket. This year we have the obvious problem of eligibility. That’s why and how most of us found ourselves on alternate news sites and blogs like this, for the truth, for our nation, for our Constitution, and hopefully for our honor. These values must not be betrayed for expedience. If these valued principles are betrayed, we are no better, if fact we would be worse for our hypocrisy, and for our phony fight. While I am well aware and pledged to vet the POTUS candidate for NBC, and will not vote for any unproven NBC candidate, that is not the immediate purpose of this composition. The purpose of this is to taunt and challenge Marco Rubio into being the honorable man demanded of his privilege of having lived the true American dream. I myself believe he does not deserve that privilege, he has not earned it, or if you think he had, he’s lost it. In fact he has betrayed it. He has forsaken it for expediency or complicity or personal gain: if not for wealth, then for power or stature. He does not fool me any longer. He is a coward and a traitor for the obvious reason: his silence. Marco Rubio is no better then Barack Obama. What!!!? Why, you ask? I’ll tell you why, but first, let’s deal with something that sickens many of us daily: Sean Hannity. Hannity is an American traitor, a dishonorable loudmouth, a hypocrite, a Constitutional opportunist, and the worst kind of voice for America, and he is not alone. Our airwaves seem full of traitors these days. Sean is compromised. He accuses Chris Mathews of the worst kind of worship, constantly reminding us of what we all know, Chris gets tingly feelings in his legs when Obama speaks. Well I have both heard Sean coronate on radio and seen him coronate on T.V. as the next prince and heir apparent, Marco Rubio. I have seen him mock conservatives who challenge NBC and mock and dismiss Joseph Farah to his face. But when he begins his Rubio raves, it makes Chris Mathews look disinterested in Obama by comparison. In fact, when he does speak of Rubio, the ‘Talking Head’ Hannity appears to be having more then tingly feelings, he sounds or looks more like he’s giving ‘talking head’, then being one. He in fact looks and sounds more then tingly in just his legs. He obviously lusts for Rubio. He is sexually aroused. The terms: ‘conservative’ and ‘man worship’ are in opposition and the phony Hannity reminds us of this in his Mathews diatribe vs. his Rubio crush and it’s embarrassing. Despite the movement we have in the nation against ineligibility, he blindly promotes it, and brands us as hypocrites unlike himself. He makes us out to be phonies, Alinsky like, accusing others of what he is guilty. Then there is the issue of his constant use of our Constitution as justification of all things Obamanible. I need not define this to the choir. Can I say Hillsdale? Have you been educated in the Constitution by Hillsdale? Has Hillsdale’s Dr. Larry P. Arnn explained this to Sean or satisfied your questions? Or has Dr. Arnn been silently complicit on Natural Born? Allowing us to be mocked by his carnival ad barker, Hannity? Does Obama do anything constitutional in Sean’s opinion? Sean would have us believe that the worst criminal violator of the Constitution: Obama, wouldn’t stoop to forge a document? How about Obama’s mentor Bill Ayers, the inventor of I.D fraud 101, is he incapable? Isn’t Ayers Sean’s proof positive of Obama’s evil connections? Next we have the betrayal of friends, his mocking of Farah, his abandonment and blacklisting of Corsi and his ‘throwing of Sheriff Arpaio under the bus’. Weren’t these people all trusted allies, brought to his shows for validation of Hannity’s own position? His soldiers of justice, brought in to win his war of words and debate? Yet, as soon as the debate required honor, these previously trusted allies became ‘persona non grate’, even worse they became lepers and invisible, more so branded liars overnight These men are you and me, in spirit, and he mocks and denies them and us, he is a Judas. Then finally for now, but not the complete list of Hannity sins, is his cowardice. He claims free and open debate, might I say he is the poster boy of the ‘Fair and Balanced’ lie we all see and are repulsed by, while refusing any debate, any discussion, any examination of all things ‘eligibility’ while promoting Rubio, a clearly ineligible luster of praise, and thereby mocking all of us, who simply want the truth and an explanation of Natural Born Citizen in a public forum, based on facts and evidence, the evidence of our sacred Constitution. Isn’t that what justice is? Screw you Hannity, you’re a traitor along with everybody at Fox and more so. Those in your business, many of your friends and peers, claim to be rallying the troops while you all hide your chickencrap (sic) heads in the sand. Is it for fame or money or are you just another enemy of the state, or more so, cowards without honor?
OK, now for my problem with Rubio, which is short and simple: Never before in our nation have we needed a true statesman, a man of honor, integrity, truth and more so: a hero, then at this moment. This call is loud and clear, unavoidable for Rubio to hear:’ Marco your country is calling’. We need a defender of our Constitution, who is in the position to make a difference, to bring to conclusion a situation unlike any our nation has ever faced, someone who has nothing to benefit except truth and honor. We need a fearless and principled servant who has both motive and opportunity and a deafening call to duty: to be of service in the noble and urgent battle to save our nation. This man, Rubio, could be that man, should be that man, but ignores this call. He in fact evades this call. He sits on his ungrateful butt and basks in praise. I did not come to praise Caesar. I came to expose him. His American life and privilege, his rise to Senator as a first generation native born citizen, his adulation, his wealth of riches and power, of life and freedom demands repayment, yet he is silent, penniless if you will, in repayment. I do not and will not accept that he is unaware or naïve about the fiery debate of eligibility, that his own eligibility is not staring no glaring back from the mirror, especially when getting ‘talking head’ from the embarrassing Hannity. He knows this evil and he ignores it. We all know this problem could be resolved with the simple ‘standing’ issue coming to a head, that battle is Rubio’s and he is clearly aware of it, but most clearly absent. His absence of repayment defines his qualifications as ‘prince’ of the party, heir apparent, and statesman and that definition is coward and traitor. Let us try one time to redeem him, to yank him from the dark side, to call him to a duty greater then his lust for being Prince, lets ask him to do what many have done: to pledge life, property and sacred honor, let us demand that the next time Sean Hannity wants to blow his whistle up Rubio’s princely ass, that Rubio says this:
“ I cannot in good conscience allow for anyone to promote me as a candidate for the office of Vice President, let alone President, as I am not a Natural Born Citizen, because neither of my parents were citizens at the time of my birth. I am not eligible. I am forever grateful for the privilege of being ‘native born and that my children, in two quick generations can achieve what I cannot. Thank you. America. The constitution as I understand it requires both parents be citizens at the time of birth for Natural Born Citizenship. I am honored for your trust, but I can only serve this nation in earnest at another position. I am honored to be a Senator, so please, do not feel that I’ve been cheated. There remain other great opportunities for me to serve. Let us instead resolve this issue by being faithful to our Sacred Constitution. Rules are written for reasons and the intent of our founders meaning of Natural Born is now more obvious then ever. I can’t be Miss America either, so be it.”
Citizen Rubio, you can no longer claim ignorance, if you run from this call you too are a traitor, you must respond, get off your ungrateful ass before you become our enemy, speak up now, then and only then, will I return to my respect for you, Marco Rubio. Your country and your party will pay an awful price if you don’t.

This pledge forever guarantees I will not vote for any Presidential ticket that is not transparently and fully guaranteed to meet the Article 2 Section 1 Clause 5, “Natural Born Citizen” requirement. I forever affirm that I will either skip my vote or vote for the opponent of: any candidate who does not take this pledge nor commits to renew and obey their Constitutional oath. I swear to follow through to it’s end the truth and prosecution of Barack Obama’s crimes against these United States and it’s Constitution and the truth and prosecution of any and all collateral crimes by any sworn official, be it of silence, omission, complicity, violation of oath, bribery, blackmail, coercion, extortion, intimidation or failure of duty to the citizen’s or Constitution, no matter the consequences: ‘It’s the Truth Stupid!’ This pledge shall be considered my official notification to The Republican National Committee, that they may take this timely and limited opportunity to change their duplicitous ways, to end their silence, to pledge to not present a Non-Natural Born Citizen Presidential Ticket, and to prosecute the obvious mystery and fraud known as Barack Obama and to admit their part in this fraud and accept the consequences or accept that:” Failure to do so will cost them my vote: be it for President or any other office sworn and pledged to uphold the Constitution. So help me God.”
‘It’s the Truth Stupid!
It’s my simple understanding that a “Fascst is someone who will ignore or brake the LAW when it’s socially and or politically correct to do so by a Minority”.
A majority would change the Law.
I do not see a dimes worth of difference between the POTUS and Mr. Romney. I think all of the choices we have are tough to make a decision on. The future of our beloved Republic is in the balance and is on the precipice of destruction. The inflection is painful and is sorely needed. Who is best for America. Pray to the Lord, and ask him for guidance. If you don’t believe in God, then think it through very thoughtfully. Research all that you can. I hope and pray that as a nation, we come to the best possible choice for freedom. I believe that Dr. Ron Paul should be in the mix and should not be disregarded in any way. In comparison Dr. Paul may not be the ideal candidate, but he is better than the other two. I will write in Dr. Paul as my vote for POTUS. God bless the Republic! Now, let’s try to keep it.
The one diference I can see is one is American.
I do not believe that Obama is an American citizen. His father definitely was not. He has shown me that he is against America. Rubio is an American citizen. Neither of his parents were born here, but they are naturalized citizens. I do believe that Rubio loves this country and wants to do good for us. Don’t know how it stacks up legally, but I like Rubio.
obama is an Indonesian citizen. He became one when his step-father took him to Indonesia and made him an Indonesian citizen. obama NEVER repatriated and THAT is how he was able to use his Indonesian passport to visit Pakistan when Americans were forbidden from doing so.
THEY ARE DESTROYING US… In law, once a court has ruled one way, changing what has been, the law changes to the new way, making everything that follows the same, which is a simple way to explain what some are trying to do with our constitution. However, the law and the constitution are different. A law is easily changed, but the constitution is much harder, taking an act of congress and the people’s vote.
If Romney does pick Rubio to be his vice president, using Obama as the reason for his being able to do so, and gets away with it, the constitution is then worthless. We then have a republican acting no different than Obama and the rest of the democrats. He will be helping to destroy our country, turning it into an illusion of what it once was.
Romney, by picking Rubio, against what Hannity proclaims is no reason to get upset, gives all who want to see our great country fall, as the USSR and countless others did, more reason to keep trying to destroy us. For without a constitution what do we have?
Day by day, fool after fool, we are coming apart one piece at a time, and I am beginning to believe it is only a matter of time before we no longer exist. We have fools in the congress and senate, fools walking our city streets, fools everywhere screaming the same thing, give me, help me, take me, show me, buy me and other than that… what do we have? A bunch of wimps as representatives who say nothing, except give me your vote and I will say something, then hearing from them later, I tried…
Again, we are in trouble and I wish I knew the answer to why so many fools would let things get in this shape, especially when they are with us? Maybe they know something we do not, but what could that be?
