Republican presidential candidate Mitt Romney says rival Newt Gingrich’s idea to send Capitol Police or U.S. marshals to bring judges before lawmakers to explain their decisions is neither practical nor constitutional.

Romney says the answer to out-of-control judges is not to tear up the Constitution and say that Congress is the ultimate power in the country. Instead, he says the Constitution should be followed when it comes to removing judges or reversing judicial decisions.

Romney made the comments Monday night on the Fox News Channel.

Over the weekend, Gingrich leveled wide-ranging criticism at the judicial system and suggested that as president he could ignore some Supreme Court decisions and would seek to abolish left-leaning courts. He also said Congress should subpoena judges to explain their decisions to lawmakers.

  1. It is not only "practical", but necessary and required under that same Constitution.
    Judges are there to uphold and apply THE LAW, not to make their own biased 'judgements' on what they think the law means.

    In order for a law to actually BE LAW, it must be clearly understandable by the common man, otherwise, it is someone's opinion that he is expected to obey and not THE LAW itself.

    I agree, Romney is already pandering to the libs & rhino's, ,judges need to know there will be consequences when not following the constitution which is the ultimate governing law!!

    There is a simple way to reign in judges who refuse to follow the Constitution and/or insist on legislating from the bench. We must change the method of choosing judges, including Supreme Court justices, from appointment to election. Election of judges works at the state level: It will work at the federal level as well. Some say election of judges will make the process too political. Guess what folks! The current method is VERY political. At least with elections the people will not be stuck with a bad judge for 20+ years. Impeachment? Forget it! The last time Congress had the guts to impeach a judge was in the 1880s. Even then he was impeached for his conduct outside the courtroom, not any of his rulings.

  5. Newt just wants to be the next King…….like King Obamination……………..and disregard our Constitution……
    which has been our problem with presidents for a long time. The Constitution doesn't let them be kings……they just assume the power.
