Rick Perry has many ideas about how to change the American government’s founding document. From ending lifetime tenure for federal judges to completely scrapping two whole amendments, the Constitution would see a major overhaul if the Texas governor and Republican presidential candidate had his druthers.

Perry laid out these proposed innovations to the founding document in his book, Fed Up! Our Fight to Save America from Washington. He has occasionally mentioned them on the campaign trail. Several of his ideas fall within the realm of mainstream conservative thinking today, but, as you will see, there are also a few surprises.

1. Abolish lifetime tenure for federal judges by amending Article III, Section I of the Constitution.

The nation’s framers established a federal court system whereby judges with “good behavior” would be secure in their job for life. Perry believes that provision is ready for an overhaul.

“The Judges,” reads Article III, “both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office.”

Perry makes it no secret that he believes the judges on the bench over the past century have acted beyond their constitutional bounds. The problem, Perry reasons, is that members of the judiciary are “unaccountable” to the people, and their lifetime tenure gives them free license to act however they want. In his book, the governor speaks highly of plans to limit their tenure and offers proposals about how to accomplish it.

“‘[W]e should take steps to restrict the unlimited power of the courts to rule over us with no accountability,” he writes in Fed Up! “There are a number of ideas about how to do this . . . . One such reform would be to institute term limits on what are now lifetime appointments for federal judges, particularly those on the Supreme Court or the circuit courts, which have so much power. One proposal, for example, would have judges roll off every two years based on seniority.”

    While I appreciate Rick Perry's stand in most everything I have seen so far to-date, we do not want to get rid of the good judges on the Supreme Court along with the bad ones, so the idea of imposing strict limits of this nature may turn out to be doing more harm than good and I therefore disagree with it. There ARE 3 branches to our government so it seems to me that the House and Senate OUGHT to be able to put the brakes on that one while permitting him to lead the country as President in every other good way should he get the nomination and win the election next year.

      While I agree with your concern of losing good judges, I have to agree with Perry on overhauling the system. Especially with the judges that obummer put in there. There are a few Supreme Court Judges who have their own agenda and who have no business in that position. The United States has grown to the point where there has to be some overhaul. As long as it is for the good of our Nation.

    • Nice thought but, how has it worked so far with the judges. They have trampled on the people countless times. The people ought to have a say in the performance of these "untouchables". They have become so political they are a joke. Surely you took some thought to how the House and Senate have been able to "put the brakes on that one" lately. They are an incompetent, corrupt, collection of professional politicians.

    • I think his suggestion, and that's all it was because the man is thinking, was not getting rid of the good with the bad. But, examining the performance of judges, whether they legislate from the bench or abide by constitutional law has merit.
      And, since there are the three branches of government to deal with such ideas, the President has limited powers in such instances.
      I think, because Obama has got away with "bending" laws, with support of his corrupt DOJ, we are becoming overly sensitive to any ideas, from anyone, regarding examination of the present systems.
      I don't know how you feel, but I would trust a Rick Perry in lieu of a Barack Obama.

Let me add…my research is NOT from liberal websites…it's from conservatives sites and from folks who actually live in TX. I can't speak for the rest of you but, frankly, I'm tired of being lied to…by BOTH parties!

      One has to take this into consideration.
      I think all who are running are really good people. We just have to hope to nominate the best one.

      The anti-Perry forces are busy on the 'net trivializing and demonizing. They're aware that many of us won't buy into their propaganda, but they're also aware that some will. They're aiming for the "some will." Remember that before Perry it was Romney, Bachmann, and Palin who were the targets of opportunity! And they were bombarded!
      If we criticize Obama, we do it from the aspect of his ineptitude, his reckless spending, how he's scoffed at the Constitution.
      Can the Democrats do the same about present Republican candidates? Not truthfully.
      They'll be on our websites with exaggerations and falsehoods.
      I think it's best to do one's own research in more places than the internet. There are some good books out there, too.

        Yep, that's some deep thinking–especially considering that many of the Perry criticisms seem to be coming from conservatives who see him as a cross between flip-flopper Romney and George W. Bush. Some of us liberals, on the other hand, would be thrilled to see Perry get the nomination.

        Perry is now assuming the would-be savior role that Fred Thompson did four years ago. And once conservatives–not liberals–know more about him, he'll probably be competing for the same TV gigs selling reverse mortgages.

    • Obviously your research material is not Texas based umless you are reading the Austin or Houston(liberal) papers. As a Texan ,I have dissagreed w/Perry on 2 policy moves,1.requirement for cancer vac's for juv. girls and 2.the trans Tx.tollroad. Other than those 2 he has steered Texas on a winning course for the last 11 years w/o raising taxes. In fact he reduced our property taxes and every year we have a sales tax free weekend to help families prepare for their childrens school needs.Don't drink the liberal kool aid befor checking the source!

    • Obama is reputed to be a Constitutional scholar, and must know that there are three distinct houses of Government, yet he ignores Congress by issuing Executive Orders, bypassing Congressional participation. His latest order, allows 300,000 illegal aliens to stay in the USA,and enter the work force, in competition.with hundreds of thousands out of work US citizens. Who does this man represent? The answer is obvious. What happened to the Federal Law of legal Immigration and what do we tell friends waiting in line for paperwork to come here? I don't recall hearing immigration law was repealed,or when it occurred. .     I really like the idea of repealing the 16th amendment. This is also called for in the FairTax Bill, which would make our tax system easier and more transparent, and would stop all manipulation from lobbyists and Congress. I also really like the idea of having our Senators appointed by the State instead of direct elections, this would make them more responsible to their State and the people. Either that or limit them to 2 terms in office. As it is now, so many politicians go to Washington for reasons of power and greed and care nothing for this Nation.

    • This is the way Senators are supposed to be nominated – through the state legislature thereby making the voice of the locality far louder and our participation far more important – hear hear

    • Senator's were appointed by the state prior to the enactment (1900's) of the 17th ammendment which changed it to an election with a 6 year term.

  5. Also from Texas (although not native-born) I have lived here 20 yrs and I agree with AmericansRon2U. But I also agree with Fred. I might be able to agree the Constitution MAY…(only MAY) need a re-write in this area, but Slick Rick is not the one to spearhead it. He should be kept as far away from elective office as possible.

Iam sorry to say that I don't believe anything a poltician say's anymore. on either party….What bothers me, once we start allowing them to toy around changing the Constitution, tweeking it here and there, before you know every new president that don't like something in it, will want to change it too, and before you know it all of our laws and values that have sustained us for years will be totally gone to suit only those in Govt….Personally, Im for leaving it alone. But I must admit the part about the judges limited terms does sound good.

    • I am with you Andi. I do believe some do need to go but don't mess with the constitution, its there for a very good reason. Perry i wouldn't trust with anything and yes i am from Texas. Bachman is good looking and all but just like Palin, does not know what she is talking about. Ron Paul has the best agenda out there. He doesn't sling mud and the media is scared of him, that's why they don't publicize him. This is not right, we need to know about ALL the candidates. And last but not least,Obama, he is one sorry person that can't even prove he is an American. He should be thrown under the jail for showing a dressed up birth certificate to try and fool the American public. He has done nothing but SPEND SPEND SPEND.   7. There is no need for term limits for judges' tenure in the federal court system. Congress can limit appellate jurisdiction of the court or dissolve the entire court system if it sees fit. (Article 1, Section 8, Clause 9) Only the Supreme Court remains beyond the control of Congress.
    The problem with the Supreme Court lies in the beliefs/values of the judges. We have a nation and its Constitution based upon Christianity. As the Founders admonished, it is reasonable, therefore, to put in positions of authority only those who profess a belief in Jesus Christ, but that would not be a test for the office. The Court is currently constituted of several members who, for all intents, are either pagans or hold no allegiance to the Saviour. That group is reactionary and activist and consistently refuses to address the Constitution as relevant to modern times.

  9. Examination of Art.. III, Sec. I seems like a worthy idea to me. The words "good behavior" as they apply to judges may have been sufficient at a time when political ideologies were not stronger than belief in the Republic, but what about now?
    I question even the qualifications of Obama's Supreme Court selections. They were selected just as the rest of his selections for Czars and advisors were, striclly form the "inside players" he knew, even with doubtful qualifications.
    How does that stack up with the constitutional wordage "good behavior," and can this "good behavior" really be expected of them? Perhaps the Founding Fathers were in accord regarding the deep feelings of patriotism and the honor of being an honest, forthright, citizen, but what about now?

Moreover, it was the state of Texas that has been so contributory during armed conflicts such as the Civil war and the Mexican American war – Texas is a crucial state and it bothers me that liberal ideas are creeping into this GREAT STATE through the like of Perry and others.         My bother has been a physician at MD Anderson for over 30 years. I have made many trips there although live in NY.
        I see nothing liberal about Rick Perry. Nothing.
        I know quite a bit about the Civil War, I am a frequent visitor to Gettysburg and other battlegrounds on the East coast.
        ALL states on this side of the country played a huge part in the Civil War. Texas is no greater than any of them. It also is not more crucial..size means nothing to me. We do appreciate your electoral vote though!

          • I don't even know if Rick Perry knows that the Muslim god is not the same god as the God of the Bible. Allah was just one of 360 pagan gods worshipped before they god rid of their other gods and kept only Allah whom they would like for us to believe is the same god as our God of the Bible but who is not. Allah expects them to kill infadels, those who do not believe in Islam and Allah and the Koran (sp?). I heard Perry was a Methodist which is a far cry from an Evangelical Christian.

    • Los has apparently not been a Texan very long or has been drinking liberal koolaid.Prior to 1965 Texas was predominately democrat.It is not however the same democrat party of old and many like Reagan and Perry have abandoned them as they changed their agendas. Texan's have increasingly embraced the conservative viewpoint over the last forty years and we have not elected a democrat gov. since Ann Richards (80-84).

    • I've been Texas all my life, and when I learned of Perry's intention to build the trans-Texas
      Corridor (but keeping it virtually secret) which would be owned by China and allow foreigners to enter our country via this highway in Mexico and go all the way to Canada, etc., and his willingness to sell out Texas this way as well as be a part of who knows what, i.e. eminent domain, etc. Also, he pushed for the dangerous drug to be mandated to our young daughters. I don't trust him. He's a "politician" it appears more than he is a conservative leader. His self interests could come first I think.

And that was when life expectancy was much less. That is even more reason to not have judges serve for life today. The judges in recent years have decided that their job is to legislate from the bench….and they do so with a green light from congress. It's a shame that our leaders have become so corrupt.

  25. Any politician that suggests that the constitution is the source of our problems and therefore it needs to be changed is presumptive and dangerous. We need to embrace the constituion as it is written. Our problems all stem from the fact that we have strayed from the constitution. Look at all our problems.. deficits, entitlements, taxes, wars…none of this is allowed by the constitution. We need to get back to the constitution. Ron Paul is the only politician that understands this simple truth deep in his heart.

    • IMO this problem isn't one of them and even some of the Founders lamented the unbridled power of the SCOTUS! Our Forefathers had the wisdom & humility to give future generations the opportunity to amend the Constitution (they did it themselves) recognizing that as great as their work was, it may not have been perfect! This is no small responsibility. Amending the Constitution is difficult – as it should be! We need to be very cautious about this and extremely certain by a broad consensus that the changes are needed and are proper! IMO the people who want to scrap it altogether are the most dangerous!!

    Victoria , As Justice Scalia mentioned a short time back , there are four branches of Government ! "And the most important is the people" , that 4th branch .
    That is why there are County's changing the politics at the grassroots level . How did we form this nation ? Assembly's ! They are a Constitutional group that works in your County , non partisan and powerful . How's that National thing working for ya ? It isn't and the Tea Party can attest to that in the debt limit and balanced budget boondoggle .
    But many believe that is our only avenue .
    As to Perry , I'm interested but not sold . There's a way to go and I want to hear more . Ron Paul worries everyone in DC and so I'm not discounting him at all . He is one who would change politics as usual and go back to the Constitution that was set aside in 1931 . We are ruled by executive order which is a dictatorship , plain and simple circumventing both houses .

I agree with Perry on most of his ideas as to how to correct many of our errors that have come about with our country becoming socialistic, atheistic and government controlling our entire lives- before birth to death. Replacing our tax system with a purchase system, FAIR tax, etc. would change lots of reasons the incompetents get into office. They are bought by the people who have their hands in the till. Term limits are a must for all courts, officials. I only question his proposals, so far, on the state legislators appointing senators. BUT maybe they couldn't do any worse than what we are getting with public voting. We would just have to be sure our state legislators were competent. EPA & IRS gone= HEAVEN on earth.

    I don't agree that we need to limit the tenure of judges, but we certainly DO NEED to check the morality and judgement of those who appoint and confirm them. The bench is not about legislating, it is about interpreting the law as written, by good, wise, and moral men and women. What we have now, is a system that attempts to appoint radicals or common sense people, based upon who is currently in power. This can be corrected ONLY when the people, the true source of logic and common sense, i.e., power, start using logic and common sense. As Plato so eloquently stated: be involved in politics or be ruled (or judged) by your inferiors. When Americans decide to act as rational human beings, who understand the principles this nation was founded upon, and therefore act in line with the intent of these principles, things will work again. There are priorities: God, family, and country. Observe these more closely and we will save America and the hope of the world also.

    I still think re-confirmation is a better route, not just getting new blood. You want senior wizened people on the Supreme Court. You just want to get rid of the renegades! Re-confirmation is based on performance and not rhetoric. The whole idea is to reduce as much as possible manipulation of the court by special interests and a vote BY THE PEOPLE is in my opinion the best way to do that (yes the media can impact the vote with biased reporting, but let's hope the drudging the American people received by electing Obama will be a lesson well remembered.)
