Montana state Rep. Bob Wagner is proposing legislation that would require candidates for president to document their constitutional eligibility in his state, but his plan would take the controversy one step beyond other state proposals.
His outline would set in state law protections for the taxpayers of Montana to prevent them from being billed for “unnecessary expense and litigation” involving the failure of “federal election officials” to do their duty.
“There should be no question after the fact as to the qualifications [of a president],” he told WND. “The state of Montana needs to have [legal] grounds to sue for damages for the cost of litigation.”
Montana is not the first state to consider acting on the issue of the eligibility of presidential candidates, in light of the fact that Barack Obama’s qualifications under the Constitution’s eligibility requirements have yet to be documented.
Several states, including Montana, considered such plans last year, but they largely were defeated by the exercise of political influence, not by votes.
This year WND already has reported that efforts are under way in Pennsylvania, Georgia and Texas for similar plans, with Arizona is likely to be in on the campaign.

I don't understand why these "CHICKEN SHIT" lawmakers have NOT ENFORCED our Constitution and thus FORCED this USURPING MORON to either PROVE his ELIGIBILITY or RESIGN!!! He has committed more (many more) Impeachable acts than all of the previous presidents of our country combined, including the other Moron Clinton! So why hasn't he been IMPEACHED? I think some of the legislators are afraid of George Soros and his ability to ruin them over-night. We do need people of good character in office and I agree that Obama should be forced out of office immediately, but that is not going to happen with the current congress, especially the Senate and one-third of the House Republicans. Furthermore, impeachment will not necessarily remove a sitting President; both Jackson and Clinton were impeached in the House, but the Senate did not impeach either, therefore no trial or conviction occurred. What good will it do if only the House impeaches Obama and the Senate does not follow through? He remains in office to continue his usurpation of our Constitution and the destruction of the United States. Obama must commit such a wrong as to outrage even his most ardent suppporter in order for the Senate to get off their xxx and follow through with the full impeachment process—and I don't see that happening, do you?

Eligibility: Good for Montana. If enough states follow suit, the Illegal in the Presidents office will not be able to get on the ballots. That would sure keep him from winning if he does run again. However if there were not so many corrupt idiots in Congress this would have been resolved long ago.
Me either, they have no balls, they all took an oath of office and if they can't abide by it…they should resign and let someone else hold office that can and will uphold our constitution.

Barack Hussein Obama will no doubt leave office as the unequivocally most despised president in American history by everyone but illegal aliens, Muslims and indigents. He has utterly failed to live up to his oath of office by being in accordance with taqiyya, the Muslim amnesty to do anything at all to expand the cause of Islam and since that advocates the replacement of the Constitution with Sharia Law, he is guilty of BOTH violation of his oath of office and high Treason. Congress needs to unite and settle the issue of his CITIZENSHIP by BOTH Houses DEMANDING it. By this one act, we could begin to heal the divisiveness between the American people and THEIR OWN GOVERMENT which has existed as the result of BOTH parties but needs, for our national survival to cease and desist. The American people deserve better than what we have had by several administrations but by far, the most damaging has been this one. Wagner's proposal should be an Amendment to the Constitution, not just a Montana law. WE NEED the protection it would afford us.
I can agree with almost all of your comment, but have an issue with indigents supporting Obama; many do not and, therefore, should not be lumped into the mix. We do need the protection of law to keep ineligible individuals out of the running, but even moreso, we need to curtail the Electoral College from putting individuals into office that did not carry the popular vote. As it is now, 43 States have no restrictions on how these members cast their votes and as recent as the Bush/Gore campaign, the EC went against the wishes of the people (Gore won the popular vote by a landslide and EC put Bush in the White House). The EC membership is governed by their respective State and not the Federal Govt.; therefore, the State must place the restrictions upon the EC. Therefore, voter protection is necessary on both counts and citizens need to contact their State legislators regarding the Electoral College issue.
There should be a cap on all campaign funds; as it is, the likes of Soros and Obama can pay for the position they seek in office or at least pander one who would fulfill his desires (as in Soros' backing of Obama). Too, the Electoral College should be limited to casting their votes to the candidate that carried the popular vote for their respective State–the Electoral College HAS voted against the popular candidate (most recent: Electing Bush when Gore won the popular vote by a landslide) and the danger is there if the popular candidate is in opposition to Obama in 2012 but the EC puts Obama back in the White House.
As to Obama having a "dollars and sense" objective, that is laughable; he has the dollars (and the legality there is questionable) and certainly no sense where it comes to supporting the Nation you reside in. Obama's agenda is to be our last elected President and first dictator–he is a tyrant, a despot, and probably the worst liar to ever inhabit the White House (his lying seems to be rather pathological). The US Supreme Court CAN remove Obama from office IF proof is tendered that he is illegally holding office. Unfortunately, the Supremes appear to be beholden to Obama for whatever the reason…it would be nice for once if we had politicians in office who genuinely CARE about the American people and this Nation. Sure, we have a few, but that isn't enough–we need a majority to do the job and are not afraid of the incumbant in the WH. Hopefully, in 2012, the PEOPLE will have their way and Obama will be charged for known criminal activities and convicted of same.
