For those of us that spend hours online, writing, blogging and reporting this judges decision is a serious additional threat to our freedom of expression. Citizen journalism, blogging, micro-blogging, it doesn’t matter what you call it. It is a form of journalism that isn’t controllable by the elite establishment. Expect more attacks as we continue to tear down the corrupt infrastructure known as the lame stream media. Here is the a wire service report about the decision:
A federal judge in Portland, Ore., has ruled that a Montana blogger was not a journalist when she posted online that an Oregon lawyer acted criminally while a trustee in a real estate bankruptcy case.
Media observers said Wednesday the ruling points out how state shield laws and other laws protecting journalists have lagged behind developments in online media.
U.S. District Judge Marco Hernandez ruled last week that Crystal Cox of Eureka, Mont., cannot claim the protections afforded to mainstream reporters and news outlets. He also found that Bend attorney Kevin Padrick was not a public figure, and the bankruptcy case was not in the public interest.
The ruling opened the way for a jury to award $2.5 million to Padrick and Obsidian Finance Group LLC from Cox for defamation.

What have they added to the water in the State of Oregon? I know fluoride is toxic, poisonous, and responsible for much of the intentional dumbing-down of America, but Oregon is apparently receiving an overdose. Do you suppose, if all members of the Oregon legislature and judiciary were tested, they might garner a cumulative IQ of 75?
Another judge to be removed. His failure to be able to understand the Constitution is the reason. It demonstrates that he can not read and can not understand the English language.
This is exactly what must be done. We must remove these judges. Most people do not vote when they see judges' names on the ballot because we don't know anything ABOUT the judges. Their political affiliation is not made known to us, nor do ournewspapers publish their rulings except in wildly public cases. We must make it our business to find out who they are. Most judges are first appointed but then elected thereafter.
If you have noticed, all of the judges who found ObamaCare to be legal were appointed by Bill Clinton. All judges who it it in violation of the Constitution were appointed by Bush 41 or Bush 43. This is why we must defeat Obama next year. If re-elected he will appoint even more activist judges. Then we can kiss our country goodbye.
I am a journalism student right now and so find the revelation that shield laws lag behind developments in on-line media interesting and important to know. Since the liberal "progressives" can not defeat the sound arguments against there own unsupportable views they who cry "Tolerance!" shall, in the near future, attempt to re-write the laws as their judges do every day in our courtrooms. ENOUGH! We must defeat them in the courts, we must VOTE and defeat them at the polls, we must cast the liberal theologians who embrace the radical historical-critical school of textual criticism – which bases its entire foundation on a supposed JEPD structure from which the text of the Bible supposedly originated and for which there is not one single shred of evidence. No papyri, velum, codex, potsherd, nothing. (read Ch.15 of 'Evidence That Demands a Verdict' by Josh McDowell) – out of our church's leadership; they are the one's who maintain we should fellowship with and 'tolerate' the depraved homosexuals. We must not tolerate their lies any longer. The freedoms that have been handed down to us are not slipping out of our grasp – they are being wrenched from our hands by lying liberal legions. It's time to fight the liberals in every arena. When you meet someone who supports abortion, call them a murderer. When you meet someone at work who is an open homosexual or lesbian – tell them that you view them as depraved and that they are headed for an horrific eternity separated from the Love of God that is in Christ. When you see the liberals attempt to re-write the shield laws so that they protect their 'bastard children', the abortionists and homosexuals, stand-up and VOTE them down. Read the book 'The Marketing of Evil' by David Kupelian and the book 'Eurabia' by Bat Ye'or. Read the Constitution of the USA. Read the Bible and pray.
For those of you who do not know how far left Oregon is, here's a sample. The city of Portland is full of panhandlers and druggies living on the streets. And the enablers don't even want their streets cleared of these people. They just give them money and walk around them. Young people brag that they panhandle all day and do drugs and get drunk all night. They are the original "occupiers." And now, according to this judge, I suppose they can all sue me for libel simply for posting this.
When you go to the polls and the question is: Shall Judge XYZ be elected for another term? Always answer NO. That is generally my primary reason for voting. If there is a choice between the lesser of two evils, write in someone you know who will be honest and adhere to the Constitution.
Just listened (today on c-span) to the hearing of the U.S. Attorney General Holder before Congress with reference to the Fast and Furious mess…One Congress lady questioned him regarding a domain name withheld for over a year from a hip hop group…While that had no reference to this situation, it was specifically stated by the A.G. that todays bloggers were journalists and had rights as such (as I understood the conversation between the two). Perhaps this should be passed on to the lady, hopefully it could help her situation. I have no means to do so myself; please reference the Congressional Hearings re: Fast & Furious of December 8, 2011. She should be able to extract the information I heard with this reference. Thank you.
