The Supreme Court’s denial of certiorari on lack of standing in the Kerchner case, coming after the multitude of no-standing cases, essentially confirms that the SCOTUS will not extend Marbury v Madison to review alleged Congressional deriliction under the Constitution, as opposed to alleged Congressional legislative infringement under the Constitution. That’s what Kerchner really means in legal terms — the Court defers to Congress on Const. Art 2, Sec 1.
This does, however, set the stage for the House of Representatives (first at the Armed Services Committee) to review the upcoming Lt.Col. Lakin Court Martial in the event the Lakin Military Tribunal refuses discovery. In essence, the Congress WILL undertake discovery.
And so THAT is how things will end for Mr. Obama, and very well could lead to new House Speaker John Boehner becoming either the 45th President of the United States (or the 44th POTUS if Obama’s ‘presidency’ were nullified, which POTUS nullification the SCOTUS felt it simply could not undertake as an extension of Marbury v Madison).

Turns out that McCain in his legal response to birther lawsuits against him also used the matter of standing. His lawyers showed that the people who sued him did not have standing to sue. Obama's lawyers have used this approach in their response to about sixty (60 or more) lawsuits against Obama, and the courts have found for Obama in EVERY case. This means that under the law both McCain and Obama are right and that the plaintiffs really did not have standing to sue.
You don't like this? Your solution is to change the law. No member of Congress has proposed doing this.
Where every American voter has standing is in Congress, which could investigate Obama's place of birth if it wanted to. But so far not even one member of Congress has proposed an investigation of Obama's place of birth or his Natural Born citizen status. Why not? Because the fact that he was born in Hawaii is supported by overwhelming evidence.
McCain DID prove his natural-born citizenship status to (the Democrat-party-in-charge) Congress. Wonder why they did not require the same of Obama, who has many more questions than McCain that surround his citizenship status???
The military officers who have questioned the legitimacy of BO qualifications have "standing"! They are not legal birth certificates, but are called "souvenir" certificates. A legal, long form birth can only be obtained from the Health Dept.of the county of birth, after showing identity to prove you're entitled to receive it. We have not seen a passport, or a legal, long form, (from the Health Dept.) 'Birth Certificate.' Congress has not investigated, not because AKA has proven his eligibility, but because they are, for one, cowards.
