A hearing Monday is set to determine whether the U.S. Justice Department will get its motion to dismiss a lawsuit challenging the constitutional eligibility of Barack Obama to hold the office of president or whether the case will move forward to be heard on its merits.
Will the case go to trial or will the judge dismiss it?
California judge David Carter scheduled a tentative trial date for the case for Jan. 26, 2010. But, to meet that trial date, the case must survive an Oct. 5 hearing on the Department of Justice motion to dismiss.
The California lawsuit is brought by several political candidates and party officials, including former U.S. ambassador Alan Keyes and Wiley Drake and Markham Robinson of the American Independent Party.
They are suing Obama alleging that he was not and is not eligible to be president under the U.S. Constitution’s demand for a “natural born” citizen in the Oval Office. Forty-six of the plaintiffs are represented by Orly Taitz, who has worked on a multitude of lawsuits over Obama’s eligibility, and two – Wiley Drake and Markham Robinson – are represented by Gary Kreep of the United States Justice Foundation.

Simple question: why won’t Mr. Obama permit an independent verification of his birth documentation records which are on file in Hawaii? What is he hiding? It is quite reasonable to conclude that, based on all the circumstantial evidence, Mr. Obama was indeed born in Kenya. If he was born in Kenya (as I believe he was) then it will be impossible for him explain why he committed this fraud on 300 million Americans. Of course, he will be forced to step down, and then we’ll have Biden as President (and probably Hilary as VP). That is very little consolation for the massive fraud, but at least the truth will then be known.

Mel, anyone who could conclude that Chairman Obama is not hiding his past, is either a moron, or a Marxist like Obama. You don't spend 1.8 million dollars to hide something that Obama claims he's not hiding! I am not an Attorney but I was raised in a home where common sense ruled.
What this case clearly needs is a Judge who has and is willing to use common sense.
McCain has to take a lot of the blame here too. When he was told by Congress that HE had to PROVE he is a natural born status he should have been man enough to respond " I'll be happy to prove my eligibilty the very day Obama proves his." The wuss McCain saved Obama's bacon.

I don't rely too much on prayer, but I kept thinking "RIO" after I went to bed until I dropped off. My thoughts now turn to the hearing on Monday. Let's hope justice sides with We the People.

What the Hawaii DoH has released is meaningless. A record on file only indicates a record on file not the contents of that record. For instance, it is already a fact that from statehood until well after BHO was born a COLB could have been issued based on sworn affidavit of two parties. Second, where is the record of divorce which was granted SAD from Lolo Soetoro that should have generated a document for Maya? The divorce is documented now but no documentation showing the status of the children other than age and dependent status at the time of the divorce. After all she was born to a "citizen" parent and those who claim it only takes one citizen parent to be a citizen no matter where born and that a single citizen then otherwise giving birth on US soil would make one "natural born". Kind of blows that legitimacy theory away too.
I have been told from very good authority that BOH WAS born in Hawaii, my home State which would make him a natural born citizen. I believe his mother's citizenship makes that possible even though she is the only parent to be one. To me that is not the question/problem now. The $64 question should be, "what is he hiding on that birth certificate"? It stands to reason that if everything was legit on that birth certificate then it would have been proferred when he was applying to be POTUS. In my mind there really HAS to be something on that paper that is detrimental to BOH (I grind my teeth every time I have to say or write any number of ways to identify that person). So to those Kenya believers (despite what grandmother said), just have patience because some way or another, that birth certificate will have to be made public and if it proves that something not right is revealed on it, then you can rejoice with the non-Kenya believers, of which I am one.

It's very obvious from the beginning that Obama has something he does not want revealed. Else, why would he spend nearly a million dollars in legal fees trying to suppress information regarding his birth certificate, his records at Occidental College and his Law School dissertation? He could put all of this to bed if he would just present a VALID birth certificate. Period. ( If in fact he can)

At this point, after all these months, I wouldn't trust it if a b.c. was produced. Could it be that the record of his birth indicates he is indeed what he said he was when speaking with George Stephonopolis. I agree with your post 110%! This guy is dangerous and evil, as is his wife Michelle My Belle. They both hate America ("For the first time in my life I'm proud of my country" Michelle's words) but do they ever luv the Muslims. Has anyone ever looked at Barry closely? He is only 6.25% Black; he is 50% White and the rest is, you guessed it, ARAB! Isn't is obvious the way he speaks about this wonderful country in such derogatory terms, yet he is always praising the Muslim people? He didn't study the Koran for nothing while he was in Indonesia as a child! Also, read about the "Five Pillars of Muslims".

No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States.
I tssems to me that the question may not be so much where he was born. Since his mother was a US citizen, he may meet the eligibility, provided only the US citizenship was selected. However, if he was born and documented as a "dual citizenship" it can be argued that he does not meet the criteria, especially if the Kenyan citizenship was retained into his adault life.
Next question, why is taxpayer money being used to send US Attorneys to state Obama's case?? This should be on his dime since it was his decision to not provide documentation.

I think it is time to bring out the video's tht have been on Youtube for ever with Obama in his own voice telling an assembly that he indeed was not born in Hawaii or in the United States but in Kenya. It seems he has admitted prior to running for President when he was a candidate for Senator that he didn't need to be a natural born citizen to be a Senator. Everyone should copy and pass along to anyone who is interested in the truth. Our courts should need no further proof of the truth coming from Obama himself.
