Antonin Scalia SC Justice Scalia steps up criticism of healthcare ruling

(Reuters) – Supreme Court Justice Antonin Scalia on Sunday renewed his criticism of Chief Justice John Roberts’ reasoning in upholding President Barack Obama’s 2010 healthcare law and also said the Constitution undoubtedly permits some gun control.

The 76-year-old Scalia – a leading conservative on the court who has served as a justice since 1986 – also was asked whether he would time his retirement in order to let a conservative future president appoint a like-minded jurist.

“I don’t know. I haven’t decided when to retire,” Scalia told the “Fox News Sunday” program. “… My wife doesn’t want me hanging around the house – I know that.”

“Of course, I would not like to be replaced by someone who immediately sets about undoing everything that I’ve tried to do for 25 years, 26 years, sure. I mean, I shouldn’t have to tell you that. Unless you think I’m a fool.”

Roberts, also a conservative, sided with the nine-member court’s four liberals in upholding the constitutionality of Obama’s healthcare law, considered the Democratic president’s signature domestic policy achievement.

  1. I think it is time to recognize that the foretathers did not have long lives, so we should regulate that Supreme Court Justices retire by age 72 at the oldest, because way too many people at 70 and above cannot really reason or think clearly, which is what I am seeing/hearing from Scalia. Yes, some of over 70 are great mentally and physically, but too many are not. We should not be subjected to aging minds in our Supreme Court, nor should be subjected to outright crooks or liars either, which at present we have two, and an elderly woman way past her prime! They need to be kicked off that bench like yesterday!

    • Forcing Justices to retire would take an amendment of the Constitution. However, Justices do NOT have lifetime tenures; they have tenure with ‘good Behaviour.’ Supporting a decision that is against the Constitution does not constitute ‘good Behaviour.’ Congress has the authority to impeach a supreme Court Justice, just as they have that right to impeach a President. Unfortunately, most members of Congress (actually ALL of them) are guilty of treason and have shown they will not support or defend the Constitution.

    • Granted, far too many aging Justices do have a tendency to lose some power of reason…But even so, the term for a sitting Justice is “good Behavior.” Once it becomes clear that any Justice fails to reason through with the Constitution, that constitutes bad Behavior & should be removed from office.

Using the term of “good Behavior” to oust a Justice should not be limited only to advancing age either…The terminology & meaning must be applied no matter what the person’s age.
