WASHINGTON (OfficialWire) — House Democrats say President Barack Obama should consider invoking a little-known constitutional provision that they say gives him the power to raise the debt ceiling without going through Congress, where Republicans are demanding that a debt ceiling vote be linked to spending cuts.

The Democrats said in a letter that they would support the use of any authority, including the 14th Amendment, to prevent the nation from going into default, an event that some economists predict could trigger a global recession.

That post-Civil War amendment contains a section stating that “the validity of the public debt of the United States…shall not be questioned.”

As of Wednesday 21 Democrats, led by Rep. Peter Welch of Vermont, had signed the letter.

Raising the federal borrowing limit is now subject to congressional approval, which traditionally has come with relatively little resistance. But in July 2011 Republicans tied their vote on the debt ceiling to concessions on spending, generating a confrontation with the Obama administration and resulting in the first-ever ratings downgrade of the nation’s credit-worthiness.

  1. Well, the 14th Amendment is unconstitutional to begin with. Without me writing writing pages to explain, ya’ll look it up for yourselves. Just do a Google search on “14th Amendment unconstitutional”. Google only shows 483,000 hits for this phrase. Start reading. Again you can thank good old madman Lincoln for making the 14th Amendment possible. Not that he personally helped implement it, but he set the stage by setting the precedents for this to happen.

  2. We should empty the House of Representatives and the Senate then rent the buildings out to make a little money. The congress just lets Obama do as he pleases while they pretend to care anyway so at least we can save the salaries of the useless idiots plus we would no longer have the costly elections which are full of fraud anyway. Then maybe the 535 self-important jerks could start a project to get a legitimate American President and start a constitutional government again.

  3. Liberals, such as Jeffrey Rosen, claim to find legal precedence for the President to assume a legislative power. But ‘liberal’ interpretations of the Constitution ALWAYS vary from the ‘original understanding’ which was to create a hamstrung federal government in order to prevent the morphing, by usurption of unintended powers by the corrupt, of a representative government into an ever-taxing, invasive, dictatorial, corrupt, autocratic behemoth….such as we have today. [which we have thanks to left-wingers in both parties who have been ignoring/warping the Constitution for decades]
    This intent is everywhere evident throughout the document.
    PLUS they created checks-and-balances to prevent any one person or group from gaining dictatorial powers.
    Since raising the debt limit would require a LAW….and since laws come from the Legislative branch….and since the President is not part of the Legislative branch and has no authority to create law….I fail to see how Congress (at least the communis….errr….liberals in Congress) sees any basis for this authority….or would be willing to grant [unConstitutionally] this authority to any one person….unless they were willing to bankrupt our country [which I am beginning to believe is not an accident but an intent].
    With Owebama, who has displayed absolutely no/zero/zilch fiscal discipline, this would be akin to giving an 11 year old your credit card.

    Certainly totally at odds with our Constitution.

    The 14th Amendment was ratified July 9, 1868, 145 years ago, and has been an official part of the Constitution since that time. Whether it was legally or illegally ratified, we are not likely to see challenges until we elect State officials who are willing to restore State sovereignty vs. the Federal Government and begin the serious process of nullifying the 90% – 95% of federal laws and the various Treaties that are clearly unconstitutional. It is unlikely we can restore constitutional government and our guaranteed rights and liberties without starting at the State level, and most State governments will not act for the people, against federal tyranny.

    However, assuming the 14th Amendment is a legal part of the Constitution, the Democrats contention Obama can raise the debt limit by-passing Congress is another attempt to ignore the Constitution.

    Amendment XIV, Section 4 actually reads as follows:

    “The validity of the public debt of the United States, AUTHORIZED BY LAW, ….shall not be questioned.”

    There is that one pesky little phrase the Democrats, liberals and other Constitution haters always manage to leave out of their demands for unlimited spending and raising the debt limit. Their constitutional abuses and efforts to manipulate the people know no bounds.

        I’m glad I’ve made you happy.
        Although I don’t want to rain on your parade, I hope you are not reading too much into my comment.

        I’m willing to concede (although haven’t verified) the possibility that one or more Amendments were never legally ratified after the Civil War, and I am positive the federal government has been acting unconstitutionally for at least the past 100 years or so, especially since the Presidency and Administration of the Marxist-Progressive Woodrow Wilson (1913). For me, as an adherent of the Constitution and its original intent, that is the key difference between then and now—the federal violation of the Constitution and the usurpation of the rights of the States and the People.

        Although I believe secession is now a legal option, I don’t believe it is a viable option at this time. It would almost certainly have to coincide with a full-blown revolution – which may be a likelihood if any form of gun control is attempted. On the other hand,, it is essential for the survival of both the country and the people, as free and sovereign individuals, to begin extensive nullification programs against unconstitutional federal laws, treaties, regulations and court decisions. Unfortunately, to be successful, the citizens of most States are going to have to replace their elected officials with those who will actively support State sovereignty and limited federal government.

          Hey there!
          Nope I don’t think I’m reading too much in your writings. What I’m seeing is someone who is actually thinking for themselves and that was all I ever wanted to and get across to’ya. It will be hard for anyone to get just pull anything over on’ya. And you’re being very open minded about what you read, which is all good.

          It amazes me at the people here who claim to be conservative, yet are so liberal in reality. I met one here the other day, and it amazes me at how they think they are conservative, and sincere about it, yet oppose the vast majority of anything conservative.

          Of course we will disagree over some things and that is OK. We’re not clones! You’ve chosen to go about something, your studies, in such a way, that you will be studying for as long as you have any curiosity. I’ve been at it for quiet a while and know it has become a labor of love. You’ll pick up many more things as time allows, and learn them right, I have no doubt. So, I’m not gonna overly criticize you for something you don’t know, as you’ll eventually figure it out.

          I haven’t been one to direct you in how you learned anything, and I only gave a few references that were safe from controversy, letting you read to suit yourself. However now I am gonna recommend a book for you to read that will help you in a lot of areas that doesn’t seem possible by the title alone. Try reading the book, “Lincoln’s Marxists” by Al Benson. He’s a friend of mine. If you want a autographed book badly enuff, I could arrange it. While the book is about the communists that came over right before Lincoln’s presidency, through a short time afterwards, it goes into some detail as to how the communists came into power and directed the Republican Party, and those tenets/platforms/ideology in the Republican Party lasts unto this day, with us seeing those effects now. Of course the book goes into greatest detail about how those communists worked under Lincoln and how he appointed them, mainly through Karl Marx, and how they were incorporated into the union army as well as being elected to governorships…etc.. all through the Republican Party. To read this book is to also get the best understanding possible of why the Republican Party is the way it is today and why they do the things many conservatives knows are liberal and or is considered selling out to the Democrats under the pretense of compromise. Does all this perk your interests in the book?
