The presidential race is now in full swing, and we didn’t even have to wait for the party conventions that normally denote the start of the official race. Then again, I don’t think anyone is really surprised the race would be between President Barack Obama and Governor Mitt Romney. Obama is the unchallenged incumbent, and Romney has been begging for this opportunity ever since he lost to John McCain in 2008. The differences between the two candidates are startling.

The president will desperately do anything to prevent voters from scrutinizing his true record that includes a broken economy and skyrocketing debt. He may be a master politician, but his management skills score badly, particularly in the area of leadership. Thus far, he has offered no proposals for correcting Social Security, Medicare/Medicaid, the budget deficit, protecting our borders, or for providing any direction for the country to follow other than deeper into debt. He stands at the helm of a bloated bureaucratic government that is becoming more invasive in our lives and discourages business. He certainly cannot admonish the country to “Stay the course” as all of the economic indicators point to disaster. What Obama lacks in governing skills, he makes up for as a demagogue obsessed with his ideological view of America. Instead of looking for ways to negotiate a respectable budget or broker changes to the debt ceiling, he wallows in polarized politics at the country’s expense.

This election is certainly not about race or the 1% (even though the left would have you think otherwise); it’s about failed policies and leadership. Ask yourself: what are the priorities of the country? What is our direction? Is it space? Energy independence? Becoming fiscally responsible? Instead, he fabricates catch phrases such as “paying fair share of taxes,” an expression aimed at dividing the classes. He also wants to move towards Green energy and allow spending and entitlements to go unabated. He is quick to accuse the Republicans of playing politics with the nation’s economy but feigns innocence of any political wrongdoing himself. Is this being hypocritical, or is it just an example of sleight of hand? The country is now more divided than when he was inaugurated.

I find it rather ironic that President Obama, who desperately wants to be compared to Ronald Reagan, is primarily responsible for transforming Mitt Romney into the next Reagan. Originally considered a moderate, Romney is being pushed to the right by Obama’s election campaign, where he is being portrayed as a right-wing zealot. The vicious GOP primaries galvanized Romney and made him a more polished politician who is now more than ready to withstand the slings and arrows the president will undoubtedly throw at him. Now, as the Republican contender, he is beginning to act and sound more like Ronald Reagan. For example, consider his acceptance speech on April 24, 2012:

“We believe in America. We believe in ourselves. Our greatest days are still ahead. We are, after all, Americans!”

And now compare it to Reagan who said:

“America’s best days are yet to come. Our proudest moments are yet to be. Our most glorious achievements are just ahead.”

Both quotations are positive, uplifting, and optimistic. Romney is obviously taking a page from the Reagan playbook.

Frankly, Romney was not my first choice in the GOP primaries, but I am now gravitating towards him. I have heard people complain about Romney being a Mormon, and as such, they cannot vote for him based on religious grounds. Such people have to be reminded that this election is about the economy, unemployment, energy independence, and maintaining our mantle as the leader of the free world. It is certainly not about being a Mormon; it is about our survival.

As part of his program on class warfare, the President wants people to resent Romney’s success as a businessman. Under no condition should Romney apologize. After all, as we live in the land of opportunity, Romney experienced the American dream. What would be the alternative; electing a failure? I don’t think so.

After studying all the facts, I cannot imagine an intelligent person voting for Obama. They either have a distorted interpretation of reality, or they have sipped his “Kool Aid.”

I’ve been thinking long and hard about Obama’s legacy when he is voted out of office in November. He will not be remembered for rebuilding the economy, Obamacare, or “hope and change” in uniting the country. Instead, I believe he will best be remembered as the element that reignited the conservative movement in this country. It wasn’t Romney who lit the fire; it was the president who ignited our passions and taught the country to ever be diligent and never take elections for granted again. For this, we should be grateful to him for teaching us this valuable lesson, regardless of how painful it was for us to learn. Whereas he liked to portray former President George W. Bush as the poster child for failure, Obama’s legacy will be as the worst president in our history.

Let’s get a few things straight here.  As much as we all loved Andrew Breitbart’s moxie, he, like virtually every other national Conservative who was or is a part of the “establishment” (read, those who have established themselves financially, and been acknowledged by their peers) had avoided the issue of the Constitutional eligibility of the president of the United States. Much like Sewanee, the University of the South, has avoided gridiron rematches with Texas, Tennessee, Texas A&M, Georgia, Georgia Tech, Auburn, LSU, and Ole Miss since beating all eight (along with four other schools) in their 12-0 1899 season.  Far better to boast that they had once proved their mettle on the playing field than to have to do it again…in real time.

So, like the mythically-fearless Michelle Malkin, or the once-cocky and courageous Ann Coulter, the “Senior Staff” at Breitbart prefers to live off of past – and in their case, borrowed – glory. And, given their namesake’s own calculated denial of this historic issue, the youngsters at Breitbart apparently believe they can get away with it. But it’s tough trying to be all things to all people – especially when the views encompassed are diametrically opposed.

So here come the princes of political archeology – they can hardly be called monarchs in their own right – and they have a find…but it’s a sticky one.  You see, the recognized king of sequestration, the billionaire financier of burying (not excavating) the past, has declared certain digs “off limits.”  Those would be any that might uncover relics from the entombed past of the current Occupier-in-Chief.  So…to disclose or not to disclose?  Such a dilemma!  The heady thrill of breaking a story of potentially enormous national interest, as well as consequence…but on an officially quarantined (and hermetically-sealed) topic….  How to proceed?

Ah, the obvious approach…to break the story, but make sure that the purse-strings-that-be know that you yourselves don’t take it seriously.  Heaven forbid!  Bittersweet, but what could be more important at this point than one’s Arianna-approved “intellectual” (press) credentials – even if such a notion is in its very essence oxymoronic…or, just plain moronic?  So here we have it, in their own contortionist’s attempt at simultaneously claiming credit for, and dismissing, the obvious implications of a recently unearthed find:

Andrew Breitbart was never a “Birther,” and Breitbart News is a site that has never advocated the narrative of “Birtherism.” In fact, Andrew believed, as we do, that President Barack Obama was born in Honolulu, Hawaii, on August 4, 1961.

Yet Andrew also believed that the complicit mainstream media had refused to examine President Obama’s ideological past, or the carefully crafted persona he and his advisers had constructed for him.

It is for that reason that we launched “The Vetting,” an ongoing series in which we explore the ideological background of President Obama (and other presidential candidates)–not to re-litigate 2008, but because ideas and actions have consequences.

It is also in that spirit that we discovered, and now present, the booklet described below–one that includes a marketing pitch for a forthcoming book by a then-young, otherwise unknown former president of the Harvard Law Review

It is evidence–not of the President’s foreign origin, but that Barack Obama’s public persona has perhaps been presented differently at different times.

 

Wow!  Where to begin…?  Let’s start with disclaimer #1:  “Andrew Breitbart was never a ‘Birther,’ and Breitbart News is a site that has never advocated the narrative of ‘Birtherism.’”

Reading this makes me want to ask in bemused wonder:  How old are you?  (I could, of course, ask the same question of Anderson Cooper, Bill O’Reilly, Mark Levine, Neal Boortz, or Glenn Beck – who are clearly much older to a man.)  But seriously, how immature – or insecure, at least – must one be to be so concerned with what the cultural elites think of them?  Young Ben Shapiro (twenty-eight, and reportedly the youngest nationally syndicated writer in the country) went to Harvard Law. One wonders if he had been president of the Law Review if we would have ever seen one of his publications…but I digress.  Joel Pollak…sure enough, went to both Harvard and Harvard Law – just as I had expected.

While I must congratulate the two on emerging from that milieu with any non-collectivist values, it seems that neither of them escaped with a penchant for identifying and confronting the Alinsky staple of marginalization…or, they accept the practice so fully that they simply can’t bear the thought of being on the receiving end thereof.  Well, grow up, boys!  If what Media Matters says about you is a concern (and it clearly is), then perhaps you should choose another line of work.

(I recently observed with some pride that the highly-irrelevant New Times – I believe it was – a radical statist rag, no doubt printed in an abandoned warehouse somewhere near the ASU campus, had called me a “birther.”  I wouldn’t have known it except that in checking up on the circulation of some recent video productions I stumbled across it.  My point being that it made me laugh…not cry. Why would I – or anyone over the age of, say, thirteen – care?  Short answer?  He wouldn’t…that is, if he had any sense of his own self-worth; and I thought that was all they taught in school these days!)

So, the timorous teens immediately jump on the pejorative (and proverbial) bandwagon with “Birther” and “Birtherism.”  What does that mean, Joel?  Are you referring to those who not only profess to believe in the Constitution, but are actually willing to defend it?  I suppose we should just cut to the chase then, and call John Jay “the original birther” – rather than Hillary supporter, Phillip Berg.  (It was – they were – actually, Lawrence Turley and Gabriel Chin, two highly regarded law professors, from Georgetown and the University of Arizona, who originally raised the issue with respect to Senator John McCain with the full support of the national media…and without derision, just respectful awe for this serious Constitutional inquiry, which they said must be undertaken.  According to Chin, nothing less than “the rule of law” was at stake! See Chapter 17:  “The Final Word from Professors Turley and Chin,” in the newly-released Oh Really, O’Reilly! – Part I of II.)

Why John Jay?  Because it was he who, in a letter penned to Constitutional Convention President George Washington, on July 25, 1787, queried:  Permit me to hint whether it would not be wise and seasonable to provide a strong check to the admission of foreigners into the administration of our national government ; and to declare expressly that the command in chief of the American army shall not be given to, nor devolve on any but a natural born citizen.”  (Emphasis added.)

Or perhaps we should go back further still, to Emmerich de Vattel, the contemporary legal authority of the day, to ascertain the meaning of the phrase from which the more erudite term “birther” most assuredly derived.  The Swiss diplomat was the author of Law of Nations, about which Benjamin Franklin (was he a “birther” as well?) said the following in a letter to Charles W. F. Dumas, the book’s publisher, in December, 1775:

 “I am much obliged by the kind present you have made us of your edition of Vattel. It came to us in good season, when the circumstances of a rising state make it necessary frequently to consult the Law of Nations. Accordingly, that copy which I kept …has been continually in the hands of the members of our congress, now sitting, who are much pleased with your notes and preface, and have entertained a high and just esteem for their author.”  (Emphasis added.  The source of the quote is an excellent article on the superiority of Vattel over Blackstone and English Common Law as the predominant legal source of the writers of the Constitution, as Blackstone defines “natural-born citizen” or “natural-born subjects” of the King as any born within the British Empire.  One immediately sees the motive for such a definition as it applied to “subjects,” in contrast with “citizens” who might one day command the military.)

Wrote Vattel:

“The natives, or natural-born citizens, are those born in the country, of parents who are citizens….I say, that, in order to be of the country, it is necessary that a person be of a father who is a citizen; for if he be born there of a foreigner, it will be only the place of his birth, and not his country.”

So yes, it looks like we’ve found our man! Now that we have cleared up the auspicious origins of the tin-foil-hat terms “Birther” and “Birtherism,” so skillfully employed by the youthful Pollak and company (Breitbart’s “Senior Staff”), in distancing themselves from their own explosive find, I will finalize my analysis of their Houdini-like effort to extricate themselves from what appears (to them, at least) to be a certain and painful death.

In an excruciating attempt to continue the heralded “vetting,” while voluntarily confining themselves within the officially sanctioned limits of inquiry (which excludes anything and everything – of a factual or provable nature, at least – prior to his election, or, in other words, his entire life), the post-pubescent heirs to the Breitbart legacy submit to the Soros-inspired shackles with a willingness and zeal which can only give one pause….

They heroically chastise the “mainstream” media (once again displaying a mindlessness beyond my meager ability to comprehend) for refus[ing] to examine President Obama’s ideological past, or the carefully crafted persona he and his advisers had constructed for him.”

Yep, his “ideological” past is somewhat fair game, but not his real past – things like where and when he was actually born; who his father really was (these things are a bit difficult to prove absent the same validating document that every American is required to have for that very legal purpose); how we actually got into three formidable universities (Occidental, Columbia, and Harvard) with obviously mediocre grades; and on what sort of scholarship?  (For anyone who might suggest that his grades were anything but an embarrassment, is it even remotely plausible that the Narcissist-in-Chief would not have paraded them before the world if they were?  No, it is not!)

And finally, what about the carefully crafted persona he and his advisers had constructed for him.”  Are those of us not so fortunate as to have gotten into Harvard via affirmative action (Mr. Obama could, of course, dispel that misguided notion – if it is such – by simply releasing his school records, as did his much-maligned predecessor) supposed to simply accept “on faith” that his “carefully crafted persona,” i.e., totally fabricated life story, somehow magically begins or ends with…what?  I guess I just can’t grasp the new Breitbart.com “rules” for what we can and can’t “vet”!  This is no doubt what passes for “nuance” at Harvard and other elite academic environs.  That may be, but real Americans aren’t buying it!

And what about this scholarly summation of their preemptive disclaimer?

Since the absurdity of this has been duly covered ad nauseum elsewhere, I will just conclude with the highlighted word “perhaps.”  Perhaps…the aging “Senior Staff” at Breitbart (who have clearly not yet come of age) have engaged in a desperate game of “Please don’t throw [us] in the briar patch!” – except that they were regrettably serious – but in their feeble attempt at supplanting the truth, they can’t even do that with decisiveness.  His public persona has perhaps been presented differently at different times”?

How about this instead?  His “public persona” is so ensconced, and has been so often sealed or falsified, that we know not with any certainty, where he was born; when he was born; who his father was; if his parents were ever married; why his Kindergarten Records are missing; what his real/legal name is (it was Barry Soetoro, among others, at various points in his life); if he ever reapplied for U.S. citizenship – which could or would make him a naturalized citizen, depending on his age at the time- (his Indonesian elementary school application lists his country/nationality as “Indonesia”); how he got into Occidental College, Columbia University, or Harvard; how he paid for it, or who paid for it; what his grades were at any of the three highly-exclusive schools; what he did while in the Illinois State Senate (those records are all inexplicably missing or have been destroyed); and, finally, why both he and First Lady Michelle Obama were required to surrender their law licenses (that isn’t done voluntarily, but is done in order to avoid further legal sanctions).

In summation, the Senior Staff at Breitbart.com has shown an inordinate insecurity and woeful inability to simply report the facts and allow their readers to decide for themselves what those might mean.  So, given their essentially adolescent refusal to do so, here’s what their story clearly demonstrates:  Barack Obama was either lying to us then – and the ruse continued for sixteen years, from 1991 to 2007 – or he has been lying to us throughout the five years since.  Absent any kind of legal proof – and a widely discredited digital image on a website does more to suggest fraud than to dispel it – we have only the “public persona,” which we have all witnessed over the past four years, on which to rely. And his proclivity for misrepresenting the truth is so profound that one doubts that he has ever done otherwise!

Perhaps the most honest thing he has ever done is to not compare himself to our nation’s first President – the man known for never telling a lie!  I say “perhaps,” only because I’m not entirely certain that he hasn’t – but the Obama night is still young…as are the Senior Staff at Breitbart.com!

Radical Left Begins To Turn On Their Messiah, Obama

Barack Hussein Obama has embraced Marxism since at least his Occidental days, hanging out with Marxist and domestic terrorist Bill Ayers in the 1990s and 2000s, sitting on boards and foundations with him, and funneling millions of dollars to radical ‘social justice’ groups like ACORN.

Something that happens to all socialists and communists that gain power, however, is that they come to like living the high life, so while they are redistributing wealth, they tend to redistribute it into their own pockets.

The hardline Left that do all the legwork to put their token Marxist in office tend to not like this and come looking for the dictator that they have installed as The One to usher in their communist utopia. And this is exactly what is happening today with Obama.

The socialist/communists/anarchist Occupy movement that Obama and the ‘Progressives’ (that is, communists and socialists) in Congress embraced, lacking their utopia, are beginning to make some grumbling sounds. The Occupy movement that Obama has coddled is doing more than protesting. Now they are taking on the strategies of Obama’s crony from his New York days onwards, good old domestic terrorist Bill Ayers, who in the 1970s rarely changed his underwear but liked to set a bomb about once a month to keep ‘The Man’ on his toes.

But Obama is having too much fun golfing, going on lavish vacations, buying his wife expensive clothing and jewelry, and throwing lavish parties with the Hollywood elite to be bothered with the rabble that his Marxists babble sought to save.

The Occupy Marxists, however, don’t go away so easily. When they invest in something, they want a return on their investment. Perhaps the only form of capitalism that they approve of: “We put you in office, you better deliver.”

Obama, coming into the office of the presidency as a Marxist, now engaging in state capitalism (large corporations, unions, and government bureaucrats and technocrats controlling the economy and society at large), ignoring Congress, and threatening the Supreme Court regarding ObamaCare, should be impeached. Now. Today.

Democrats know that their supporters are generally not very smart. They know that to get their base to remember and understand a point, they have to reduce it to a “four legs: good, two legs: bad” mantra. In recent years, they have been very successful with this “reduce it to a bumper sticker” approach. By using Pavlovian conditioning, they have trained their followers to foam at the mouth at the words “Gingrich,” “DeLay,” and “Halliburton.” Now, they are trying to train their base to throw things at their TV sets when they hear the words “Bain Capital.”

So far, they have had no success, and at this rate, they’re not likely to achieve their goal. The problem Team Obama has is clear: not even Democrats believe they should hate Bain Capital because Barack Obama says they must.

On Sunday, the “Bain Capital is the enemy” scheme took a big hit when Newark mayor and African American Democrat Corey Booker said “I’m not about to sit here and indict private equity,” which was a defense of what Bain Capital does.

This came on top of a childishly under-verified video of two steel workers complaining that the evil Bain Capital had closed the plant they worked at. Simple fact-checking revealed this was true but happened two years after Mitt Romney, the “evil face of the evil Bain Capital,” left the venture capital firm.

Worse still was the embarrassing video Booker was forced to make on Monday. It looked like a “hostage” video, and his reassurances that he wanted Obama re-elected didn’t seem spontaneous. In response to Obama’s asinine charges against Bain, many prominent Democrats have stepped forward with support for Booker and, if not support for Romney, at least support for the concept of venture capitalism.

Among those who have joined the ranks of Democrats not willing to be on record as attacking capitalism, even if that means indirectly supporting Romney, are Ed Rendell (a former Democrat  National Committee Chairman), Harold Ford (a black former Congressman), and former Obama economic adviser Steve Rattner.

When asked to react to Booker’s Sunday comment, David Axelrod snidely remarked, “I love Cory Booker. He’s a great mayor. If my house was on fire, I’d hope he was my next door neighbor.”

For the record:  the Obama campaign says Booker was not forced to make the “hostage” video; Booker says he was. Mister Axelrod, your house certainly IS on fire.

Occupy Movement Reason Obama Ran For President?

Obama, Pelosi, Reid, and the rest of the “Progressive” (that is, socialist/communist) arm of the Democrat party have embraced the Occupy Movement since Day One. We have watched the so-called peaceful, grassroots movement “evolve” (to use a favorite Obama term) into a socialist, communist, anarchist, and anti-Semitic movement. And now with the NATO “protests” on May 19 in Chicago, they have “evolved” into a group associated with domestic terrorists.

How much more the American people will stand before this group of elected radicals led by Obama are thrown out of office remains to be seen. Let us hope it is quickly. Let us hope it is before November (i.e., impeachment), before Obama’s thugs’ goal to “Eat the Rich and Smash the State” is fulfilled—that is, they want what all socialists/communists want: to collapse the economy by unsustainable debt and entitlements, confiscate and redistribute all wealth (most of it in their own pockets), and then destroy everything so that they can build a communist utopia from the ashes.

Thanks but no thanks. We like our “imperfect” (to again use an Obama term) Constitution just fine.

 

Obama Meets The French Version Of Himself

It could be said that a narcissist’s best friend is the reflection he sees of himself in the mirror. No other relationship comes close — unless the narcissist has the unique opportunity to meet another version of himself, which happened last week during the recent Group of Eight (G-8) summit at Camp David.

“President Obama, this is new French president Francois Hollande. President Hollande, c’est le president americain Barack Obama.” “Tweedledum, meet Tweedledee.”

If, as they say, a picture paints a thousand words, then it is obvious it was amour at first sight for Obama and Hollande — ahem — as compared to snapshots taken of Obama with Israeli Prime Minister Benjamin Netanyahu; Obama’s body language expressed he’d be more comfortable sitting next to a rattlesnake.

It isn’t every day an American president hits it off so jovially with a staunch socialist leader, but these are strange days we are living in. Ignoring the obvious is supposed to be the norm.

Obama and Hollande share much in common, including the way each coasted to victory riding on the winds of social unrest and economic uncertainty while using slogans promising change. Obama used “Hope and Change” and Hollande, “Change is now.” Does it actually matter? Not really. Except for the fact that both cases show us how people are willing to compromise core beliefs when times get tough.

At the G-8 summit last week, both leaders left German Chancellor Angela Merkel as the lone voice promoting the common-sense approach to fixing Europe’s economy by living within one’s means. Instead, the not-so-dynamic duo promoted a plan for “growth.” The same kind of “growth” America experienced after implementing the stupid stimulus bill that grew the deficit instead of “shovel ready” jobs.

The type of “growth” Hollande and Obama espouse translated into layman’s terms means: The government has license to steal money from job creators so it can spend like hell.

Obama calls it “paying your fair share.” Hollande calls it “socialism.” Simintics, semantics.

Obama later joked about his failure saying, “Shovel-ready was not as shovel-ready as we expected,” which was about as funny as Obama admitting he’s in over his head. Rather than admit failure, Obama whitewashed over his “Hope and Change” slogan and replaced it with the word “Forward.” Despite obvious failure, Obama wants us to proceed forward, in lemming like lockstep over the cliff.

Thanks to a tip from a reader named Ted, I discovered the “forward” shtick has a dark side. According to Russian immigrant Svetlana Kunin, who writes for Investor’s Business Daily, Obama’s new slogan, “Forward,” is the same motto (when translated) used by a Russian anti-capitalist left movement founded in 2005 that merged with the “Socialist Resistance” in 2011. To the unaware, Hollande’s plan for “growth” includes raising taxes on job creators from 41 percent up to 75 percent. Lord knows what will happen here, should Obama be entrusted with a second term.

In the meantime, we’re already hearing talk about the need for additional stimulus spending to fix those rickety roads and wobbly bridges the first stimulus bill failed to repair. Just like an addict promising that one more hit will be his last, it’s time to admit Washington has a spending habit that cannot be fixed with another fix.

Once upon a time, personal responsibility ruled the day, and living within one’s means was honorable. Purchases extended on credit were the exception to the rule, and saving for a rainy day ensured personal “bailouts” in cases of emergency.

But that was then. We’re not in Kansas anymore, and it will take more than clicking a pair of ruby shoes together to get us home. In a scorching showdown letter dated May 10, House Oversight and Government Reform Committee Chairman Darrell Issa and Subcommittee Chairman Jim Jordan demanded that Environmental Protection Agency Administrator Lisa Jackson surrender documents she doesn’t want made public.

The seething but civil congressmen requested all the documentation that went into the EPA’s unprecedented and legally questionable attempt to preemptively block the permit of Alaska’s multi-billion dollar Pebble copper mine even before the permitting process begins.

This novel, front-end attack on jobs and economic development hinges on the convoluted Clean Water Act (CWA) and clever gimmicks lurking in its litigation-prone Section 404(c). Water is the regulator’s perfect power grab target; nearly every development needs water.

The proposed mine itself, with its massive copper deposit and smaller amount of gold, is just a convenient symbol to trigger anti-mine public emotion. Issa and Jordan evidently realized that the EPA was using the Pebble project as a test bed to inflate the agency’s total regulatory authority far beyond the clear intent of Congress.

EPA’s weapon is what matters; it’s a supposedly scientific “watershed assessment” of the Bristol Bay locale surrounding the proposed mine, conducted before the scientists had any idea of what the mine would look like, with no input from the mine developers, and manipulated to show potentially horrible damage to a prized salmon run, something scary enough to justify withholding the permit.

That’s the EPA’s clever new power grab gimmick: a preemptive veto. No permit, no mine.

Now, hypothetically apply that power to every new development in America’s future: No permit, no anything. You can see where this is going.

The Issa and Jordan oversight letter specifically told EPA to “provide the requested information prior to EPA’s release of its Bristol Bay watershed assessment, but no later than 5:00 p.m. on Thursday, May 24, 2012.”

EPA thumbed its nose at congressional oversight and defiantly released the Bristol Bay watershed assessment on Friday, May 18, to huge and clearly orchestrated media attention, showing potentially horrible damage to a prized salmon run, something scary enough to justify withholding the permit.

EPA did not provide the requested documentation to the Congress of the United States.

Obama’s increasingly dictatorial agency and its autocratic boss Lisa Jackson may not like what they get back. Rep. Darrell Issa “has become a major figure since taking over as chairman of the oversight panel following the Republicans regaining the House majority in 2010,” said Washington Examiner Executive Editor Mark Tapscott, “especially as a result of his dogged pursuit of the facts behind the Operation Fast and Furious scandal.”

Fast and Furious was an incredibly stupid undercover program operated by the Justice Department, a botched “gun-walking” project supposedly intended to smoke out Mexican drug lords by allowing thugs to “walk” firearms across the border as bait to catch higher-ups. After intense probing and confrontational oversight hearings, Issa revealed that the project had captured no big-time crooks and only inflamed border violence – at taxpayer expense. Today, Issa is an investigative hero.

When the EPA oversight issue came before the committee, Issa’s exceptional instinct never seemed to swerve off of the real target: stopping the agency from expanding its regulatory authority.

President Obama alienated West Virginia’s powerful Democrats, Gov. Earl Ray Tomblin and Sen. Joe Manchin, when his EPA used Section 404(c) to yank the lawful permit of a large and well-established in-state coal mine. West Virginia’s “coal vote” then spoke. Keith Judd, a convicted felon incarcerated in a Texas federal prison, won nearly 41 percent of the state’s May 8 Democratic presidential primary vote away from Obama. Joe Biden told the media in priestly tones, “I understand. They’re frustrated. They’re angry.”

West Virginia also figured significantly in Issa’s oversight letter; the dispossessed coal company sued the EPA for retroactively pulling its permit and won.

Issa reminded Jackson of her defeat: “Last month, a U.S. District Court judge ruled that EPA’s action in this instance was illegal. In its opinion, the Court noted:

“EPA’s position is that section 404(c) grants it plenary authority to unilaterally modify or revoke a permit that has been duly issued by the Corps [the Army Corps of Engineers] – the only permitting agency identified in the statute – and to do so at any time.

“This is a stunning power for an agency to arrogate to itself when there is absolutely no mention of it in the statute. It is not conferred by section 404(c), and is contrary to the language, structure, and legislative history of section 404 as a whole.”

That made it clear to Jackson on May 10 that Issa saw a similar court test coming on Pebble. Yet she insolently released the watershed assessment on May 18 despite congressional oversight’s instructions to the contrary.

Why was Jackson so confident of ultimate success? Who would benefit from a massive EPA power grab? Who had her back?

Perhaps Issa’s most inspired demand for documentation was this: “Please provide a list of all individuals, along with their organizational affiliations, that you have met with regarding these petitions for the Bristol Bay watershed assessment and the dates of those meetings.”

With that, the oversight letter leaves us to our own resources. Who’s on Issa’s list?

To begin, who first got the idea that Section 404(c) was the EPA’s passport to imperial power?

The EPA’s website says that “EPA initiated this assessment in response to petitions from nine federally recognized tribes and other stakeholders who asked us to take action to protect Bristol Bay’s salmon populations.”

Enter Geoffrey Y. Parker, a sixty-something lawyer in Anchorage, Alaska, who penned a 60-page article in a 2012 Seattle law review with a long title beginning, “Section 404(c) of the Clean Water Act…”

It also contained an author biography which tells us that Parker is “co-counsel to six federally recognized tribes which filed the initial petition [dated May 2, 2010] to EPA that it commence a public process under Section 404(c) of the Clean Water Act.”

The six original tribes grew to nine, and a flood of nearly identical letters came from various tribes and commercial fishing trade groups, insisting that EPA use Section 404(c) to stop Pebble mine. The letters also emphasized that “leadership and purpose” from EPA would be necessary, hinting that some kind of blank check, a large “Support EPA” effort, was in the works.

Ten months later, the EPA had the blank check. Jackson somehow seemed to know she could depend on the makers, so she cashed it. On February 7, 2011, the EPA announced it would begin a “public process” for Pebble in the form of a watershed assessment.

Parker appears to be the first person to see the possibility of slanting regulations in favor of EPA power by using Section 404(c) of the Clean Water Act, but how did an otherwise unremarkable Alaskan lawyer arrange the splashy, orchestrated anti-Pebble campaign that exploded on Washington, D.C. less than a month later?

He didn’t. He didn’t have to. His private law firm had represented the multimillion dollar angler’s group Trout Unlimited for at least a decade, and that’s where the highly coordinated anti-Pebble drive – and possibly even Parker’s idea – sprouted.  Trout Unlimited is the first name on Issa’s list.

The first Trout Unlimited event was “Save Bristol Bay Week”, beginning April 1, 2011 in Washington, D.C., with a delegation of Alaska fishermen, state and tribal officials, and students trekking through a series of lobbying visits, bigwig receptions, dinners with chefs serving Bristol Bay salmon, and exclusive high-profile events.

A congressional reception for the delegation was hosted by Senators Mark Begich (D-AK) and Maria Cantwell (D-WA). Sen. Cantwell would later write an impassioned letter to Jackson urging her to use the 404(c) authority – if necessary – to stop the Pebble mine, which swayed some lawmakers to oppose a bill by Alaska’s Rep. Don Young designed to strip the authority from the EPA.

Former Supreme Court Justice Sandra Day O’Connor, an avid fly-fishing devotee, hosted an invitation-only reception to bolster opposition to Pebble, said National Review. O’Connor would open for the headline act: EPA Administrator Lisa Perez Jackson, followed by Interior Secretary Ken Salazar.

Groups attending included Natural Resources Defense Council (2010 revenue: $99.6 million), Earthworks ($2.3 million), National Parks Conservation Association ($38.9 million) and Trout Unlimited ($26.6 million) – the Gordon and Betty Moore Foundation gave Trout Unlimited $2.6 million specifically to stop Pebble mine.

The fact that these groups were in a closed-door session with Lisa Jackson told insiders that the fix was in. She wanted supreme power, and they wanted it for her.

Shortly before the salmon hoopla in Washington began, Trout Unlimited hired a new public relations and lobbying firm, the Seattle-based Strategies 360 (run by high-profile CEO Ron Dotzauer, a political talent of exceptional influence.) He ran Sen. Maria Cantwell’s election campaigns “in all of her races since the mid-1980s,” according to a Seattle Times story.

The story goes on to say, “When Dotzauer opened his consulting firm in 1985, Cantwell, then in her mid-20s, was his first employee. They began dating, and they continued a relationship after she was elected to the Legislature in 1986.”

Sound Politics, a Seattle blog operated by gadfly Stefan Sharkansky, ran a 2006 item headlined, “Maria Cantwell was the ‘other woman’ in lobbyist’s divorce,” citing court records of that 1985 divorce confirming that Dotzauer was the “lobbyist” and a “Maria” was “the other woman.” Cantwell was a sitting state legislator at the time, and the testimony was given by Ron and Angela Dotzauer’s family counselor, who declined to give “Maria’s” last name for confidentiality reasons.

So, we could draw a path from the Moore Foundation to Trout Unlimited to Strategies 360 / Ron Dotzauer to Sen. Maria Cantwell to Lisa Jackson to an unlawful watershed study to an unlawful permit denial.

The sprawling campaign against Pebble mine is one of the most transparently self-interested and dollar-intensive in Big Green history. Yet it’s only a test bed to inflate EPA’s total regulatory authority far beyond the clear intent of Congress.

It never ends. Power lust scoffs at bounds. On May 10, when Issa and Jordan’s oversight letter was dated, and before the EPA released its Bristol Bay watershed assessment, environmentalists predictably began calling on the agency to conduct a similar assessment of mining activity in the Great Lakes region. The Bristol Bay study “is comparable to what we’d like to see” in the Great Lakes, National Wildlife Federation attorney Michelle Halley said, according to InsideEPA.com.

This journey into the innards of EPA abuse is necessarily long.
