Florida Democrat Michael Voeltz had filed a lawsuit against Barack Obama’s eligibility to serve as President of the United States and claimed that he was a threat to the safety and security of the United States. Larry Klayman, founder of Freedom WatchUSA served as Voeltz’s attorney on the case.
On Dec. 13, Florida Circuit Court of Leon County Judge Kevin Carroll gave the plaintiffs until Dec. 23 to respond to Obama’s attorneys’ motion to dismiss the case. However, Judge Carroll went against his own order and dismissed the case on the 21st. In his dismissal, Carroll wrote:
“This court notes that President Obama lives in the White House. He flies on Air Force One. He has appeared before Congress, delivered State of the Union addresses and meets with congressional leaders on a regular basis. He has appointed countless ambassadors to represent the interests of the United States throughout the world.”
“As this matter has come before the court at this time of the year it seems only appropriate to paraphrase the ruling rendered by the fictional Judge Henry X. Harper from New York in open court in the classic holiday film ‘Miracle on 34th St.’ ‘Since the United States Government declares this man to be president, this court will not dispute it. Case dismissed.’”
Carroll’s dismissal was immediately challenged by Klayman claiming that the judge prematurely dismissed the case without a proper hearing as described by state law. Klayman explained:
“This act also flies in the face of this court’s own order of Dec. 13, 2012, which was law of the case.”
“This court had a statutory duty under the Florida Election laws, the Florida and U.S. Constitutions, and 3 U.S.C. Section 5, to adjudicate defendant Obama’s eligibility and his alleged fraudulent acts expeditiously, timely, and before the electors met on Dec. 17, 2012, and before the Electoral College votes on Jan. 6, 2013. Thus, this court also violated these law is dismissing the complaint summarily.”
“This court seems to want to sidestep having to reach these serious and important matters before it.”
Klayman also noted that Judge Carroll made an inappropriate remark concerning a friend of his who had been appointed to a federal post by Obama and indicated that it may demonstrate bias on the part of the judge.

I detected many other grounds for dismissal of this judge; if not, removal from the bench.
Did he see the original movie, or the re-make version? I believe the miracle was the real Santa Claus. What does that have to do with Obama? Santa is a really nice fellow that brings us cheer and happiness. Obama does not do that.

It will end when concerned citizens get together and when a judge like Carrell does something like this which is against the law both federal and state need to have a talk with these judges and show them the error of their ways. I`m sure after a weeks vacation in a building with white walls and felling beter every day until they go home. From that point on I`m sure that they will follow the letter of the law from then on.
This judge for sure needs a good long talking to and a paid vacation courtesy from the people from the worries of the bench for a week or so. Until the people start talking to these judges and setting them straight about the law, We will have crooked judges. they are good people. They just need to be straightened out a little.

Did Florida get a Nuclear power plant or something else out of the dismissal? Surely somewhere behind closed doors someone benefited something by which the dismissal was prompted. This Judge is basically saying since congress and the federal agencies have taken no action then he will not take any action either regardless if Obama is eligible or not, or breaking laws or not, this Judge is saying it is not in his interest to enforce or protect the laws and the parties involved. So, here is another America who has taken an oath of office by which fails to uphold their oath.
Oaths are just about as much of a joke in this American society as is marriage and marital vows. Very few these days uphold their word and stand by what they say or promise by which shows their lack of principles and integrity.

If there was a single honest Judge, including those that are on the Supreme Court, were truly honest and were willing to honor their oath of office, Obama would have been arrested a very long time ago.
There could not be a single Federal Judge that viewed the undeniable hard evidence that Sheriff Joe Arpaio and his Cold Case Posse uncovered and would not have concluded that Obama past s an absolute complete fabrication and as such he should be arrested and charged with treason.

Does anyone understand that this judge is siting a fictionally based movie as his support for dismissal. This alone should be reason for pursuing his dismissal as a judge and furthering the case. This should not be the end of it. Isn’t there a law that the qualifications and documents pertaining to Obama’s qualifications are checked, and verified by independent sources BEFORE he is inaugurated for a second term? We the People need to start standing up to facts and not words from Obama. He is not above he law. He is not our boss. He is not a friend. He is just some politician trying to steal as much money from me he can. How can anyone concerned with a budget take a $5million vacation?
