Mens rea is Latin for “guilty mind.” In legal theory acting to set up a crime before committing it indicates a guilty mind; or guilty intent.
In the spring of 2009, just a few months before the Obama Administration instructed the Phoenix ATF office to commence Operation Fast and Furious, Attorney General Eric Holder introduced and secured a curious change to United States gun legislation.
The tracing of firearm serial numbers provides information about the manufacture of a weapon, its original retail seller and buyer, the entire known history of the weapon. For years, anti-gun rights zealots had procured these trace statistics from the Bureau of Alcohol, Tobacco and Firearms for the purpose of initiating frivolous law suits against both gun dealers and manufacturers.
Then, in 2004, Kansas Republican Rep. Todd Tiahrt successfully added an amendment to the yearly ATF funding bill. Known since as the Tiahrt Amendment, the legislation prohibits the sharing of trace information for any but legitimate law enforcement purposes. That is, trace information on firearm serial numbers could only be provided to federal, state and local law enforcement agencies engaged in specific, criminal investigations. Those responsible for left-wing fishing expeditions would no longer have access to trace statistics for the purpose of manufacturing lawsuits.
Then, although Barack Obama and Eric Holder had promised liberal supporters they would fight to overturn the Tiahrt Amendment, in the spring of 2009 Holder lobbied Congress for a change to the Amendment, one which would allow ATF acquired trace data to be provided to “…a foreign law enforcement agency solely in connection with or for use in a criminal investigation or prosecution…”

Prior to Fast and Furious, the Obama Regime had spent months in orchestrated repetition of the phony meme that 90% of guns found at crime scenes in Mexico had come from the United States. Was this Holder initiated change to Tiahrt meant to facilitate Mexico's repetition of the same claims, allowing MExico access to the numbers?

Actually most of the guns the cartels had up to the point of this miss step were American/Russia guns sold to other counties or given to other countries for free by countries that were updating there guns and the one's the cartels had were obsolete they previous owners thought. No gun is obsolete if it still fires. But other peoples guns are other peoples profit and in the end other peoples guns for murder.
Are problem is some of the worlds economic future is in gun sales to whom ever has the money. Having lots of money does not make them smart or law abiding, just makes them deadly. So yes it is nice we in American have the right to bare arms, but the rest of the world are not hunting for food or sport. Its for reals.

You have to look at the big picture in this situation. Hillary and Obama have both worked on the Small Arms Treaty with the UN. Had the Fast and Furious gone as they had wanted, they would be clamoring for the SAT to be passed. This law was supposed to superceed the Constitution and eliminate the Second Amendment. All guns, starting with handguns would be confiscated. Obama made an excutive order to allow INTERPOL to come into the country and make arrests and not be held responsible for violating Constitutional Law. Why was this executive order made? It is only to confiscate weapons he knew the military and the police would not do without probable cause. It would be the weapons owned by law abiding citizens, not the criminals. Then if the government outlawed guns, only the government and outlaws would have them.
There are some 150 million gun owners in the US. Of that number, I would guess 5%-7% would refuse to turn in their weapons or permit their confiscation by federal OR foreign agents, the HELL with what any "law" had to say about it. In short, Obama would have started a civil war/2nd American revolution. I believe most of the US military would refuse to fire on American citizens for the sake of Obama's unconstitutional edicts and those who would try to enforce them, a great many would wind up dead. So it's possible that the last, despicable act of the most radically leftist president in the nation's history would provide the spark which caused the reclamation of our country and liberty.

Why hasn't Congress charged Holder with a crime?I'm sure that there are some Republicans bureaucrats in the Justice Department.The Republicans need to have a vote in both houses to charge Holder and others.The vote in open floors of Congress would let the American people see how their elected officials voted on the issues of what is lawful and what is criminal.This would prepare the voters to clean up,vote out of office and charge them with crimes against the American people, their criminal Congressmen and women.
