As happens many times, the United States Supreme gave a little bit to everybody, probably satisfying nobody.

We’ve said before in the space that to depend on nine people, appointed for life, to correct a runaway legislative or executive branch is asking way too much of the legislative and executive branches.

What the Court appears to have done is to strike down the individual mandate as a matter of the Commerce clause.  That gives some of us fear that a continuously expanding commerce clause would eventually force us to buy a particular brand of car because it suits the Government.

That won’t happen.

But.

Since the penalty can be construed as a tax, and the Federal Government’s power to tax is virtually unlimited, they upheld the law on that basis.

So, what now?

Well, the justices just said, “read our lips—a whole lot of new taxes”.

In fairness, they examined the law, and the law said that Congress could do what they did under the taxing powers of the Constitution.

And we the people gave these bozos (The Pelosi-Reid Congress) that power.

We the people can also take that power away from these bozos (Congress, not the court).

If you don’t like what happened today, don’t blame the court.  You elected the Congress which enacted the bill.

Un-elect those who are still there.

  1. Concerning the SCOTUS ruling a short time ago. Here is my Yahoo response, which I will be reposting elsewhere. This is the way it is done…

    You’ve got the government you deserve!
    You reap what you sow. You’ve sown into the wind and now you’re reaping the whirlwind.

    The reason all this is possible is because the US Constitution is now addressed as being a “Living Document”, meaning it is ever changing to suit the day’s interpretation. That in itself nullifies any form of being a “republican” form of government. “Republic” simply means Rule of Law, and if the Rules of Law are open to interpretation that means no Law can always mean exactly the same thing. Or better stated, all laws are open to reinterpretation.

    It is because of the above that we now have “FORCED” health care, Social Security and a whole host of government mandated programs.

    Now, the questions become:
    Do you believe the US Constitution is a Living Document or is it strictly interpreted?
    If you believe it is a Living Document then you’ll most likely agree with the courts verdict and your president and congress being able to legislate such policy.
    If you don’t believe it is a Living Document; What do you think it will take to change the way government is run in order to address the US Constitution as a strictly defining document according to “Republican” principles of political science?
    How many of you understand and know, because of the above, that the United States is no longer a Republic?
    Which brings us to the final question; How many of you know this breech in the US Constitution occurred, and by which president that set these precedents?

    The answer to the last question is, Abraham Lincoln. He said, “In saving the union I have destroyed the Republic.” To verify this statement as being true, read Lincoln’s Address to Congress when it first reconvened in July 1861. He admits he interpreted the US Constitution of his own accord and applied his views in order to justify attacking South Carolina over firing on Fort Sumter. What Lincoln did not say to Congress was he provoked South Carolina into firing on Fort Sumter by breaking a treaty with them. The treaty can be verified by reading and knowing the telegram Lincoln sent South Carolina’s Governor Pickens 2 days before South Carolina fired on Fort Sumter. In short the telegram was to provoke South Carolina into acting by telling them that the Federal Government had reinforcements on the way, would be there in about 2 days and that the response was up to South Carolina, either submit or attack.

    People, you have attacked and conquered an innocent people. In doing so you changed many things concerning the future, most assuredly sowing the seeds of your future defeat! And not only did you allow this to happen, you NEVER once apolgised or reconsidered the actions. You stole, plundered and murdered innocent people and in the process you allowed those seeds to be sown into the wind too become a whirlwind which will now consume you and blow you away, just as you so tried to destroy my people, I will now destroy you!

We will have our America back… our first priority is removing this President and making sure it doesn’t happen again…our constitiution will be followed before we are done.

  3. This act is the prolog to the complete destruction of what was supposed to be a democratic republic. I no longer have any faith in those running our government. When the fight begins to regain it I hope I will not be too old to contribute to the cause

  4. No surprise. The Marxist puppets of ovomit did what he wanted. The states need to nullify this unconstitutional law and refuse to recognize it. Lincoln laid the foundations for the destruction of this nation, and each president since him has added his brick and morter to the alter of Marxism. War is coming. Ammo up!

    • True, they done what their puppets wanted, but nullification is a whole nother matter. Of course South Carolina toyed with nullification many years ago and in the 1950′s the SC also threw out nullification as not being a legal process. Of course special thanks also goes to good ole *Honest* Abe Lincoln for that too! (Who wasn’t honest at all, which is why he got that nickname.)

      The states will be too terrified to try for nullification and many states already have their legislatures bought off. And if one state or several did by chance pass a law nullifying that law, the Federal Government would just renounce it and possibly make it very difficult on any states in question.

      Hate it but we lost the right of nullification when Lincoln got elected. Just another precedent that he was able to indirectly set into motion to come back later and haunt us all. Gentlemen there is no legal recourse… We have a Living Document that has been interpreted to accept this healthcare law and it is gonna stick. What we think doesn’t matter, as we were defeated in our attempts to keep this from happening long ago.. We’re nothing more than property of the US Government today…. and they’re so nice and kind as to want to furnish us our healthcare…. all for a price of course….. matter of fact they’re demanding it!

      • I disagree that the states have no right to nullification. The tenth amendment still stands and has been used over the years with success. When the federal government tried to ram national id down our necks the states rejected it and it was not implemented. It’s a matter of the states saying NO to the federal government. Already 26 states have sued the federal government over Obamacare, which shows that a little over half the states are against it….it would therefore not be difficult to rein in the federal government on this mandate.
        Another case in point was when the feds tried to mandate the firearms regulation and Montana stood up and said…not only will we not be forced to register firearms manufactured and sold within our state, we will arrest any federal agent coming into our state trying to enforce regulation. There will be a stiff penalty and possible prison term for any federal agent that tries to this. The feds backed off.
        There was also the Real id act that the feds tried to push on the states but it too died on the vine because the states rejected it.
        So you see, the states do have the ultimate power. The states created the federal government….it is there as a servant of the states….not the other way around.

        • You make good points mareseb and I agree in principle. However what we think is right and what the federal gommit thinks is right and how far they will go to back up and enforce what they claim is right are all entirely different matters. If the feds have their minds set on something, they will do it regardless to the backlash. In such a case I could see some1 as Obama declaring martial law and dictating to everyone that it will be done… Just as Lincoln set the first precedent in doing similar…

      It’s nowhere as easy or cut and dried as you mite think and write.
      Actually there are MANY many people who likes the verdict are just as willing to fight and die to uphold this law as there one’s to oppose it, actually more to support it.
      And with the power and mite of the US Government backing their laws, no amount of your wishful thinking or talk is gonna change that. You have absolutely no edge in any physical area whatsoever compared ot the Federal Government. It would be folly to think you stand half a rabbit’s chance!

I would look for a few Billion dollars or Dinars in the Cayman Islands. There are “Billions and Billions”, as the Star Guy once said, involved. And the future of Liberty in the USA. Health Care can be used by the government to intimidate anyone and everyone, and OBOZO, Saudi and Soros know it.

    States Nullification Can Stop Unconstitutional Federal Laws

    The last paragraph of the Declaration of Independence states,

    “We, therefore, the Representatives of the united States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Colonies, solemnly publish and declare, That these United Colonies are, and of Right ought to be Free and Independent States; that they are Absolved from all Allegiance to the British Crown, and that all political connection between them and the State of Great Britain, is and ought to be totally dissolved; and that as Free and Independent States, they have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States may of right do. And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.”

    In 1791, Congress ratified the adopted the Bill of Rights which contained the first ten amendments to the US Constitution. The Tenth Amendment reads,

    “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    Thomas Jefferson first wrote about state nullification when he drafted the Kentucky Resolutions of 1798 and 1799. He wrote that nullification is the rightful remedy to be used when the federal government exceeds its constitutional powers. James Madison also wrote about state nullification when he drafted the Virginia Resolutions of 1798. Madison went a step further when he stated that states are duty bound to nullify or resist the federal government when they act in violation of the US Constitution.

    Jefferson warned the American people about letting the federal government assume more power than they are entitled to. He said that if the federal government is kept in check that it will continue to create new powers and grow out of control.

    Therefore there are two things that we the people can do to try to keep the federal government from exercising unjust and unconstitutional policies and laws. First we need to exercise our duty and obligation to vote for people who support states’ rights over the federal government. Secondly, we need to be actively involved in pushing our state leaders to exercise the state’s right of nullification on matters such as the Affordable Care Act (Obamacare) and all other illegal and unconstitutional laws they have shoved down the throats of we the sovereign people.

    If the governor and political leaders of your state refuse to use state nullification, like the governor in our state, Steve Beshear (D) of Kentucky, then get involved in recalling them or helping to elect one that does believe in using this power. State nullification can be and is a powerful tool that the federal government does not want you to know about. Please pass the word to others and ask them to pass it on and on and on until every American is pushing for their state to use its power of nullification.

  12. I don’t hate what you post – you have a right to your opinion – you just seem hateful in respect to something “we” have done to “your” people and that’s a little off the scale. We are Americans. We don’t shoot people here either for a difference of oppinion.
    You said that Obama might declare martial law because we are unhappy about what he did. He can’t do that just because he wants to do it – we are peaceful and law abiding and removing him by vote. I do believe he might orchestrate a big street battle so he can then call for martial law when he tells us he won the election because China said so,

      As for me being hateful about something others have done in the past. read these couple of letters.

      In his memoirs Sherman wrote that when he met with Lincoln after his March to the Sea was completed, Lincoln was eager to hear the stories of how thousands of innocent Southern civilians, mostly women, children, and old men, were plundered, starved, sometimes murdered, and rendered homeless. Lincoln, according to Sherman, laughed almost uncontrollably at the stories. Even Sherman biographer Lee Kennett, who writes very favorably of the general, concluded that had the Confederates won the war, they would have been “justified in stringing up President Lincoln and the entire Union high command for violation of the laws of war, specifically for waging war against noncombatants.”

      I know from family history much more personal stories than this.
      And how much of this are you aware of?— NOTHING!
      And what makes this even worse is the fact my people are still made to feel responsible for something they had no control over, even unto this very day.
      My culture and heritage is attacked, I and people like me are belittled and worse. And we are suppose to just sit back and think it is alright, that we deserved it? Problem is it is actually Lincoln’s fault and all the people who followed his orders bear partial responsibility.

      In the process Lincoln broke the US Constitution many times over and set precedents that are plaguing us today in exponential quantities. Lincoln destroyed the Republic and created a Federal Democratic Union, which most people have been tricked into thinking we still live in a Republic.
      (Lincoln said, “In saving the union I have destroyed the Republic.” And YOU want to know why I’m hateful? I think that’s an arrogant statement to a large degree.

      As for Obama declaring martial law, he can if he wants to.. All he has to do is give the feeblest of pretexts. Many people would love for him to do it… You know, the liberals who can’t stand anyone else, who also hates the world but claims it is everyone else that hates. We all know them as yankees, yesterday and today… Same bunch, different time, larger arena..

      Finally I am NOT an American! I am a North Carolinian! Before the war people identified themselves by the state which they lived, which then was their country. Lincoln changed all this also…. He dissolved the status of the states and State’s Right’s. Instead he made it federal and as was first done in the pledge of allegiance, especially for the Southerners, they were made to take that oath. Which now reads in part, “…one nation indivisible…” before was acknowledged as being divisible… Again denoting the usurpation of power by the Federal Government.

  13. No Michael, I don’t hate. I don’t like sometimes, but hatred matters not one whit to the person I would hate, it only destroys and causes hearache for me. Nobody is big enough or that important enough to make me give myself hearache.
    It’s has not always been easy for me, but I believe in this prayer. It makes so much sense to me.
    Lord, grant me the courage to change those things I can, to accept the things I cannot change, and the wisdom to know the difference. I’m an old lady, but I didn’t wait until I got old to gain a bit of wisdom. I’m proud of my southern heritage because today there is much to be proud. We are a people deeply rooted in a language, a heritage and customs all our own. We are resourceful and adaptive to change because we seem to make it our own. We are not perfect, as there is no such thing but HIM above. The hardest thing for me to do is forgive myself – it takes practice. Tomorrow I will be better than I was today. Each generation is guilty of it’s own mistakes, I will not hold the guilt of my forefathers. It’s enough that I try hard not to make mistakes that my grandchildren won’t pay for, but if I should I hope for their forgiveness in the same peace that I have forgiven mine,

One thing Obama and Roberts overlooked is the constitutional fact that the U.S. House of Representatives is where tax bills must originate, not in the U.S. Senate, not in the U.S. Executive Branch of Government and not in the Judicial Branch of Government. The Republican controlled house can simply refuse to introduce or pass a health insurance tax bill and the issue is over until after the November 6th general election when the Marxist Congress members and president can be turned out to pasture and ObamaCare repealed by a Republican Congress and President, then the Marxist supporting justices can be impeached for constituional bad behavior.
