If the Supreme Court has followed long standing tradition, the preliminary decision as to the Constitutionality of the ObamaCare individual mandate and perhaps the fate of the law itself was known to the Justices on Friday of last week.
After oral arguments, it is common practice for the Justices to meet Friday morning in a conference room where each Justice votes on the case, beginning with the Chief Justice and proceeding according to seniority. Shortly thereafter, Justices will be assigned the writing of majority and minority opinions and comment on various case issues. Decisions can change over the months until presentation of the final ruling, which in the case of ObamaCare will probably be sometime in late June.
Whatever happened Friday morning, it’s a safe bet that Barack Hussein Obama was the 10th person to know, having undoubtedly received a call from Elena Kagan minutes after the meeting ended.
What will be Obama’s “stagecraft” between now and the day the Court makes its decision known to the rest of us?
Many political pundits believe Obama’s chances for re-election will be seriously impaired if the Court should find his signature power grab unconstitutional. But don’t believe it.
As was made obvious by his cynical race-baiting in the Trayvon Martin affair, Obama is desperate to gin up the same level of excitement and interest among blacks that helped put him over the top in 2008. Simply celebrating a court victory will not get it done.
But if he is able to claim that 5 biased, Republican-appointed judges prevented black children receiving the same healthcare benefits enjoyed by most whites, the important campaign “race war” will be off and running.
In the meantime, it’s doubtful we will be able to divine the Court’s decision from Obama’s words or actions. On Monday, he said overturning the law “would amount to an unprecedented, extraordinary step of judicial activism.” He made it clear that the unelected Justices have no business overturning the work done by the people’s elected representatives.
And in classic liberal form, he literally dared the Court to undo the benefits already provided to some 2.5 million children and previously uninsured.
But Obama is likely to engage in the same hyperbole regardless of the Court’s decision. If the Justices ruled against ObamaCare, he would be setting the stage for public outrage over denied healthcare coverage which is the people’s “right” and for which Democrats—the Party OF the people—worked so long and hard.
And if the Court found in favor of ObamaCare he will claim that it was his power and authority as guardian of the public good which ultimately convinced—perhaps even shamed– the Court into making the “correct” decision.The God-like power of The One!
While Obama engages in political theater until the final ruling is made, all the rest of us can do is pray that Justices Roberts and Kennedy will decide the Founders did NOT intend the America people be slaves to the federal government. With our liberty at stake, it will be a nervous 3 months.

If, and this is a big” if “, one of the Justices revealed the outcome of the SCOTUS votes on Friday, wouldn’t this be grounds for his or her removal from the bench. To me, it is a gross breach of confidence and deserves to have the offender removed from the Court. However, considering the amount of corruption and grossly dishonest behavior of our 3 branches of government today, I guess we can’t expect anything to come of this, even it is confirmed.
I agree with the author of this piece. Kagan already informed Obama that the ruling was 5/4 against, thus he is now attempting to intimidate the court. He’s nothing but a thug to needs to be ousted as soon as possible.

If contact between Kagen and Obama or Sotomeyor and Obama can be proven, I hope the balance of the Court will have the fortitude to initiate impeachment proceedings for either one or both of those justices.
I really don’t think the other Justices have the authority to initiate impeachment proceedings since the Constitution in Article 1 Section 2 says “The House of Representatives shall chuse their Speaker
and other Officers; and shall have the sole Power of Impeachment.” and Article 1 Section 3 says “The Senate shall have the sole Power to try all Impeachments.”
Articles of impeachment would be required from the House of Representatives, and if approved by a 2/3 majority, the Senate would then hold the trial.
What impeachment? Obama is a criminal forger of his birth certificate and his selective service card. He isn’t even a legal president. He should get walked off today! You only impeach a legal president/ This chump is a jerk and a liar and a fraud. Congress get with it and oust this punk.

It may be that Kagan open’d her big mouth, and it maybe that the court did vote 5/4 in finding it unconstitutional, but what this president is doing by threatening the Supreme Court with intimidation can not put up with. with the possibility of this want to be SCJ, Ms kagan, I would think if she did tell the President, it is probably the first time it has happened, so the people will have to come up with a punishment of sort to take care of those who do open their mouth before it’s time. Personally, I know what I would do if it was up to me, but I will not say, because It would not be pretty. But, America has a problem with a president that goes around bulling those who does not agree, and he is a bad sport of sort. I see President Obama alway’s attempting to act as if he is a Dictator, and not our President. That in it’s self should tell America something about him. Take a look around you Americans, can’t you see or even FEEL the difference since he has been president by even the words that proceeds out of his mouth, and the socialistic views that pours out of that mouth of his. I think the situation was he was an adjunct professor. He wasn’t full time and he came in for lectures or classes involving black civil rigjts when they needed him. This is not the man so many think he is. More and more keeps coming out.
Kagan had no right to even hear this case. Had she been a woman of honor she would have recused herself as she was Obama’s solicitor-general during the whole Obamacare debacle. The Chief Injustice John Roberts, voluntarily swore in an ineligible candidate. The 8 other monkey justices sat silent. Thomas say’s we’re avoiding that issue: meaning eligibility. They are all complicit and traitors already. What the eff’s the difference? If they rule on his namesake initiative and decide any single part of it is Constitutional isn’t that back door legitimacy? Won’t they being saying the eligibility issue can never come up, it’s been decided? Would the United States Supreme Court rule something was Constitutional if the signer Obama was illegit? Backdoor legitimacy, giving Obama claim he’s legit and then allow the Dems to claim the Republican ticket is not legit if Romney doesn’t establish his NBC once and for all. Then if Rubio is on the ticket all bets are off because no way is he eligible. the republicans are stupid and complicit already don’t get your hopes up. the Court is compromised and criminally complicit and was from the day Roberts gave the oath. 5 to 4 ruling in favor of some parts they throw the mandate out and the new congress after the election rewrites and makes it a tax or Obama just issues an executive order that it’s a tax. If the republicans field an ineligible non-NBC ticket he’ll either suspend the elections beforehand if the polls suck for him or void them with executive order after losing. Remember his ability to order martial law. It’s all about the elections. Win and he’s god , lose and he’s god and the republicans are part of it if they offer a non proven NBC ticket. Our own judicial system is corrupt as well, and for all we know, this Obamacare debackle may just be *staged*. When Roberts swore obama into office obama’s ineligibility sounded only like a remark from a sore loser. It was not until later that the eligibility issue took a life of its own.
Of course, I’m convinced Obama knows the Friday vote of the Supreme Court. But it will be just about impossible to figure out what that vote was based upon what he will say or do over the next months. For example, the arrogant attacks he made on the Court Monday. What if he knows the Court ruled in his favor, but said those things in order to convince anyone paying attention that he does NOT know! After all, if he were pleasant and complimentary of the Court, it might suggest to people that he DOES know the ruling went his way! Reading tea leaves on this will be very tough.

Scary stuff. I have to believe he knows…either from Sotomayor or Kagan. I’d like to see that exposed but that’s doubtful. The only way this can be stopped is by the voters. Obama literally has a gun pointed to the head of anyone that gets in his way.

People keep saying we should not underestimate him, but I do not believe he is as smart as some think he is. He looks to me like a man that is losing control.

That’s a very real possibility. The Liberal members of the court HAVE voted against obama in several cases, including three 9-0 votes.

Forget the petition to Congress. Congress as a body has made it perfectly clear it has no intention of vetting obama, although a few individual members are VERY interested in doing so. Several state legislatures have also balked at the idea by refusing to address the issue or keeping pending legislation “in committee” for several months. The time has come for the people to take direct legal action.
People who live in a state that allows public referendum should IMMEDIATELY start gathering signatures for a vote that would require a presidential candidate to include a certified copy of his/her long form birth certificate as part of the ballot application package. Each candidate should also be informed that the authenticity of all documents in the package must be verified before that candidate’s name goes on a ballot in that state. No judge could rule this “unreasonable” because it would only be unreasonable for someone who was not born in the USA.
There is no more time to wait for Congress or state legislatures to take action. The people must take action to get the matter settled before the November elections.
