An activist judge in North Carolina said prosecutorial racism was the reason he commuted the sentences of four convicted killers.
Described as three of the state’s most notorious death row killers, among the group’s victims are three law enforcement officers, two women and a teenager. The judge was able to overrule the first sentence under the state’s controversial Racial Justice Act.
Commuting a black man’s death sentence to life in prison, the judge cited “the persistent, distorting role of race in jury selection in North Carolina.”
He never argued the man – found guilty of kidnapping and robbing a teenager before shooting him in the face – might be innocent. Since the Racial Justice Act gave him the discretion, he simply declared prosecutors were racist and gave a murderer a get-out-of-death-row-free card.
Republicans subsequently gained control of the state’s legislature and enacted a new, pared down, version of the act. Apparently, that didn’t present an obstacle for the black judge who commuted the sentences of three more murderers – including two cop killers – later the same year.
Concluding race was a factor in jury selection, he presented some handwritten notes supposedly proving prosecutors tried to eliminate blacks from jury pools to back up his claim.
One killer is a Lumbee Indian convicted of murdering two women and shooting another in a gang initiation; the other two are black men who killed a total of three law enforcement officers in separate incidents.
“This conclusion is based primarily on the words and deeds of the prosecutors involved in these cases,” the judge ruled. To the casual observer, though, it seems his conclusion might have roots in his own idea of racial justice.
Some in the courtroom expressed vocal disagreement to the ruling, including the brother of one murdered state trooper who shouted an expletive as the judge spoke. As about sixty uniformed police officers left the courtroom, a woman in attendance yelled at them, urging them to shed their badges because the legal system could not protect them from criminals.
Activist judges from the Supreme Court down can cause significant damage to our system of law. Although prosecutors plan to appeal the judge’s ruling, this case proves America’s justice system is not immune to moral relativism and race baiting tactics.

I have noticed that almost all verdicts handed down by judges now seem to reflect what would be obama’s or holders opinion.
They were probably in for killing white people…….that would qualify them to join the Obama administration as social justice czars!
I see yous did not say who this Judge is by name or what county or court he resides in, i just wounder why ??

Part of this is from the lack of initiative on our part to address and solve the race problem we have had in this country for way to long.There is no side working effectively to bring us together Black or White.All the other problems we have are the same systemic lack of focus on real problems instead of the corrupt and heavy political manipulations of both sides. We have allowed God ,Justice,Common sense and our basic rights to be at risk because we were to busy to get involved ,and now that we are involved we find that what was once law that could be applied to solve a problem or wrong minded issue is now not available.The sad part is that we still allow this to continue ,The Tea Party was formed to address the slide from grace to anarchy.So why are we throwing poop at each other like a bunch of noisy monkey’s .Because we still have just the bare necessities we need to get by and we are waiting for some one else to do the work while we watch The zombie program or Honey Boo Boo or other stupid vacuous diversions.Money is becoming worthless and food is doubling in price,God was removed in a public display of evil by the heavily Communist Democratic Party.They are coming for your guns and shut the hell up about you will do this if they come for yours,they have armament and tanks and planes you would be toast so get real.Get your money and your self to a Tea Party group as soon as you can and start doing the last thing available before the Camps start filling up with citizens needing “Re-educating”.And as for the race situation professional Black families who work and pay taxes were and are a group of people who we should have been bringing our message of smaller Govt and less business regulations to .They also have seen the break down of the family and the push for the radical homosexual agenda and the removal of God from the public discourse and they are far from happy about it and would have been perfect partners and fellow patriots as they have been since before 1776. A missed opportunity that still can be addressed just made more difficult. Now Please Turn off that stupid “Boo Boo” thing and get to work.
hotrodrobert, you are so right. Unfortunately it is not like the Civil War where it was North against South. Now we are spread so very far apart. A few Tea Partiers here, a few over there, etc. And I try and tell my friends the very same thing when they continue to purchase gun after gun after gun. All the guns in the world won’t make a bit of difference, if there are just one, two, or a few of you/us. The government has weapons we’ve never even seen. The weapons they used in Benghazi are nothing compared to what they’ll have to use on us. Or, even if they did use those same weapons, we’re toast. But, we too, will stay and fight for our beliefs. I cannot be “re-educated”, and I refuse to go to one of their torture camps. So, it doesn’t leave us too much for an alternative. But, we’re old and would be considered useless anyway. Other than all of this, ain’t life grand?

Madison warned in Federalist 47, pg. *198-199:
“Were the power of judging joined with the legislative, … the judge, would then be the legislator. Were it joined to the executive power, the judge might behave with all the violence of an oppressor.”
If the Judge is guilty of exceeding his authority ,the state should be removing the offending judge from office by Impeachment ,while ignoring his rulings.

I can TOTALLY understand why prosecutors might want to exclude Blacks from a jury panel when the guilt or innocence is being determined in the case of black defendants. In the early 90′s I had a friend who sat on a jury in downtown Houston. The defendant was Black and obviously guilty. During deliberation, the lone black juror would not vote guilty and gave the explanation, “I know he’s guilty but I can’t convict a brother!” The trial ended in a hung jury and the case had to be tried again at the expense of the taxpayer. We all saw the same thing happen in glaring fashion during the OJ trial. Most Blacks are unable to objectively and fairly evaluate and render decisions. They will defend and side with the skin color above all other. Very sad.
