The Liberty Legal Foundation has filed an appeal with the Georgia Superior Court in the case of Weldon v. Obama, one of the three Georgia lawsuits claiming Barack Hussein Obama to be Constitutionally ineligible to serve as president of the United States or to be included on the Georgia ballot.
It is probably significant that the very act of filing the appeal was fought by the Superior Court clerk’s office which claimed that an additional $2 fee had not been included with Liberty Legal’s paperwork for the filing of separate motions.
Additionally, the Court Clerk invented numerous excuses to prevent the filing, moving from one to the next whenever it was pointed out by Liberty Legal attorneys that none reflected normal court operating procedure. According to Liberty Legal attorney Van Irion, the clerk’s conduct was, in the course of his entire legal experience, “unheard of.”
As a side note, although the paperwork had been provided some 7 days earlier, the clerk’s office failed to inform Liberty that there was a problem. The clerk simply “sat on the petition” and the filing deadline of TODAY would have been missed had Irion not called to make certain the filing had taken place!
The appeal itself is based upon the claim that the “rights of the appellant [had] been prejudiced because the finding of the Secretary of State (was) affected by…error of law.”
That is, Georgia Secretary of State Brian Kemp, who approved Judge Michael Malihi’s Administrative Court decision, had done so in spite of (or due to) mistakes of law made by the Judge in deciding the case.
As Irion states in the appeal, the decision of the Judge “not only violates…precedent and rules of construction, it runs contrary to Supreme Court precedent.”
Specifically, Liberty Legal argues that the decision of the court:
- 1. Violated rules of Constitutional construction
- 2. Misapplied Minor v Happersett (1875 Supreme Court case)
- 3. Ignored the clear definition and precedential status of Natural Born Citizen in Minor
- 4. Ignored the Minor Court’s discussion of other categories of citizens
- 5. Ignored a Minor Court holding concerning the 14th Amendment
- 6. Relied upon the severely flawed Indiana State Court ruling, Ankeny v Governor
Along with the appeal, Liberty filed a preliminary injunction prohibiting the Secretary of State from including Obama on the Democrat primary ballot in March.
Also of importance, although Judge Malihi received a “Motion for Contempt” from Liberty Legal attorney Irion concerning Obama’s willfully ignoring a subpoena and failure to appear at the January 26th Court hearing, Judge Malihi refused to certify the facts of the motion to the Superior Court. In short, he just SAT on it and did nothing, contrary to the CLEAR demands of Georgia law! And NOW the Court claims it no longer has jurisdiction over the motion because the case has moved on from the court!
What will the ruling be on the Petition for Appeal? Given the obvious and overwhelming judicial misfeasance—possibly malfeasance—on the part of Administrative Court Judge Malihi we can rest assured that failure on the part of the Superior Court to overturn will be a clear indication of either bias or cowardice.
And such an unwillingness on the part of the American judiciary to honorably perform its moral and Constitutional duties for either reason would spell disaster for the legal system. For it would afford ample reason that the American public might ignore the very legitimacy of the law itself.

His re-election campaign people did the actual dirty deed and all Nixon did was to support his people. Only after multiples deaths of innocents peoples and the “risks” for riots on the street, something happened. Violence on the street is a bad situation. I am afraid for us law abiding citizens. A lot of people do not understand EQUAL justice vs SOCIAL justice. Natural laws make us with differents gifts: hockey players (mostly white), basketball players (mostly blacks), Actors, singers, they all make more money than us. Let’s put this into context. So, concerned Americans using Constitutional law, follow all the rules, everything, go to court to prove Obama’s not eligible to be on the ballot in Georgia. Let’s see. We follow the rules, the judge does not. Obama does not appear in court per subpoena. Obama wins case! NOW, we’re going to follow the law again, and take this up the ladder to the higher court. The clerk for the court is trying his damnest to throw a wrench in the paperwork, so that the appeal is not filed in a timely manner. Let’s see. Looks to me like a fix is already underway. Everything and anything to protect Obama and keep his sorry a** out of a court of law. Do I have that right?

The United States of America has not been a Republic since the time the states switched to the winner takes all system of awarding electoral votes. With this system of vote counting the winner of the popular vote in each state (other than Maine and Nebraska) gets all that state’s electoral votes. In other words if you live in a state that the majority vote Democrat and you vote Republican your vote for President goes in the trash can. This action transformed the Constitutional Republic into a Constitutinal Democracy. During World War 2 President Roosevelt gutted the constitution with his War Powers Act, and later started our country down the path to a Social Democracy when Social Security was enacted. The only good thing to come out of the disgraceful goings on in the Georgia court room of Michael Malihi is the fact that the legal elements of an Obama eligibility case have FINALLY been ruled on. All previous cases had been dismissed as a matter of process. And that meant there was nothing to appeal, no way to get to a higher court and no way to really get the crux of the issue to the public.
But, as pathetic as the Malihi decision was, at least it was a decision! Now the American public will have a chance to find out whether the judicial system operates according to the law, or according to politics, political correctness and the dictates of the radical left.

There are no surprises left as to what the Republic of the United States of American can expect. We are witnessing not a recent development, but something that has been in the shadows of government for years. How many? Perhaps it could be traced back to the 1930′s, when the Great Depression brought about a number of Socialistic style programs. I believe this was the a first step in our eventually arriving at this time. There have long been enemies of our Republic seated in high places with but one goal, our demise as a nation. An in-depth study or our more recent history hints at the subtleties of the usurpers. Of course, we Americans are so arrogant and naive’ as to disbelieve the possibility that such things can happen here. From what little I’ve seen to date, the birthers have still not focused on getting the relevant and material facts. They are ignoring the probable facts to focus on fiction that raises a phony legal issue.
They are deluded by the notion that Obama’s father was an alien Luo tribesman. Trouble is, he ain’t the father. He adopted Obama at birth. Comparison of Obama’s DNA with that of close male relatives of the alien Luo prove to a reasonable degree of scientific certitude that Obama is not the son of the alien Luo. Other reports confirm that there remains an undisclosed original birth certificate showing that Obama was the son of two U.S. citizen parents. The original birth certificate, confirmed by Obama’s DNA, will show him to have been a natural born U.S. citizen at the time of his birth, as indicated by Dr. Fukino in her statement of 27 July 2009.
So the position that Obama was ineligible at birth because he had an alien father is bunk. The alien thought to be his birth father, claimed by Obama to be his birth father, wasn’t.
By propounding this false notion, in the foolish and mistaken hope of a quick fix, the birthers put the judge in the position of excluding a man erroneously believed to be half Negro from the ballot because of a Negro man he misrepresents to be his father. The judge fears civil strife and criticism if he does so, so he adopts a frivolous legal interpretation of “natural born citizen” to keep him on the ballot.
Obama refuses to release his original birth certificate, releasing an incomplete picture of his adoption certificate instead, for two reasons:
- To conceal the fact that he is not half Negro, the basis of his political career.
- To evade the investigation of his naturalization as a citizen of Indonesia as a lad, which was probably confirmed as an adult. While people fuss about non-issues regarding his eligibility at birth, they pay no attention to his potential loss of U.S. citizenship, which would cost him his eligibility if proved. He can’t be a natural born U.S. citizen if he is not a U.S. citizen at all, even though he was a natural born U.S. citizen at birth.
There is also a tendency to fall into error once a decision is reached regarding eligibility at birth, as if that determines eligibility for all time., As indicated, status at birth can change. If U.S. citizenship is lost, eligibility to the Office of President is lost.
The real eligibility issue is the effect of Obama’s Indonesian naturalization on his American citizenship. The U.S. State Department explains the effect of foreign naturalization, a potentially expatriating act, as is a conviction for treason:
POTENTIALLY EXPATRIATING ACTS
Section 349 of the Immigration and Nationality Act (8 U.S.C. 1481), as amended, states that U.S. citizens are subject to loss of citizenship if they perform certain specified acts voluntarily and with the intention to relinquish U.S. citizenship. Briefly stated, these acts include:
1. obtaining naturalization in a foreign state [my italics] (Sec. 349 (a) (1) INA);
2. taking an oath, affirmation or other formal declaration to a foreign state or its political subdivisions (Sec. 349 (a) (2) INA);
3. entering or serving in the armed forces of a foreign state engaged in hostilities against the U.S. or serving as a commissioned or non-
commissioned officer in the armed forces of a foreign state (Sec. 349 (a) (3) INA);
4. accepting employment with a foreign government if (a) one
has the nationality of that foreign state or (b) an oath or declaration of allegiance is required in accepting the position (Sec. 349 (a) (4) INA);
5. formally renouncing U.S. citizenship before a U.S. diplomatic or consular officer outside the United States (Sec. 349 (a) (5) INA);
6. formally renouncing U.S. citizenship within the U.S. (but only under strict, narrow statutory conditions) (Sec. 349 (a) (6) INA);
7. conviction for an act of treason (Sec. 349 (a) (7) INA).
ADMINISTRATIVE STANDARD OF EVIDENCE
As already noted, the actions listed above can cause loss of U.S. citizenship only if performed voluntarily and with the intention of relinquishing U.S. citizenship. The Department has a uniform administrative standard of evidence based on the premise that U.S.
citizens intend to retain United States citizenship when they obtain naturalization in a foreign state, subscribe to a declaration of allegiance to a foreign state, serve in the armed forces of a foreign state not engaged in hostilities with the United States, or accept non-policy level employment with a foreign government.

If people would seek the facts instead of striving for a quick and easy result on the basis of a stipulated fiction, and subpoena Obama’s original birth certificate and his DNA and the considerable mass of conflicting evidence regarding his potential loss of U.S. citizenship, state secretaries of state would have a basis for informed and rational decisions with regard to his eligibility.
Until the facts are thus disclosed, Obama is likely to continue playing the birthers like a toreador plays a bull, and they will, out of faulty analysis and ignorance, continue to suffer ignominious defeats.

She had no problem releasing a cop killer, so how do you think she will rule on her god Obama? The evidence won’t matter, the fix is in. Just like the media, the outcome is per-determined. The only question is how they will spin it.
I had hope that there MIGHT be real justice concerning his not getting on ballots but even THAT is ‘do NOT touch’ to judges who are either straight corrupted OR they’ve had it made very plain to them that to go against this ‘person’ occupying the White House is to bring severe consequences upon ones self. This administration holds pretty much all the cards. I hate believing this but NOTHING has changed the status quo in THREE YEARS. Looks like when push comes to shove those in the White House can shove harder. It’ll take a literal MIRACLE for this to change. SO PRAY FOR THAT MIRACLE!
